7. 10/02/09 – SGRV ignored our 10/02/09 Injunction against Harassment #2009-000202 issued against SGRV’s employee George Kieffer who on 10/01/09 had threatened to kill us. SGRV gave a key to Carol’s SGRV #1027 apartment to Mr. Kieffer in order to look at the apartment’s first reported water leak and mold problems. 9. 10/05/09 – SGRV’s Scott Green took Mr. Kieffer to his attorney, Scott E. Williams, and paid for his legal representation against our lawsuit #CC2010-038651 Fairall v. 10.  10/05/09 – SGRV’s Karl Nunley refused the usage of SGRV’s visitor’s apartment that was customarily used when a SGRV apartment had become unfit to occupy. We told Mr. Nunley that we were getting sick from the toxic mold smell and that the water leak was dangerous to our limited mobility issues. Mr. Nunley stated Mr. Green had given him strict orders not to help us. Our request for the SGRV loaner apartment was decline. (Responsible Party: SGRV’s Scott Green)

11. 10/05/09 – Received SGRV’s attorney letter threatening to sue Carol for the nonpayment of her SGRV #1027 apartment would be filed. SGRV issued a Notice of Noncompliance which gave Mark ten days to move from Carol’s SGRV apartment otherwise he would be arrested for trespassing. 12. 10/05/09 – Karen Olach, Fairall’s renter, filed an unwarranted Injunction against Harassment against Mark Fairall which prevented his scheduled 10/08/09 Fairall rental property inspection for damages. (Responsible Parties: SGRV’s Scott Green and attorney Scott E. Williams)

13. 10/08/09 – Carol’s SGRV #1027 had the second water flooding but SGRV still refused to resolve the life threatening problems. (Responsible Party: SGRV’s Scott Green)

15.  10/08/09 – SGRV ignored Carol’s 10-day Demand Repair Demand Letter to fix the water leak, eliminate the mold, and fixed other the reported problems in her SGRV #1027 apartment. (Responsible Party: SGRV’s Scott Green)

16. 10/08/09 & 10/09/09 – SGRV’s attorney made it clear in emails to our attorney that SGRV had spent a lot of money answering our Fair Housing Complaint was going to retaliate. Scott E. Williams stated that SGRV had invested a lot of money to fight us because of our filing a Fair Housing Complaint. 17.  10/09/09 – SGRV’s attorney, Scott E. Williams, refused our attorney’s, Mark Tucker, email making the REASONABLE ACCOMMODATION REQUEST FOR A DISABLE PERSON to accept Carol’s Medication for delivery. Mr. Tucker even addressed the unresolved water flooding and mold problems and stated: “This strikes me as clear bad faith and retaliation.” (Responsible Parties: SGRV’s Scott Green and attorney Scott Williams)

18. 10/09/09 – Carol was sued by SGRV for the nonpayment of her rent and the trial date was set for 10/20/09. (Responsible Parties: SGRV’s Scott Green and attorney Scott E. Williams)

19.  10/10/09 – Carol’s SGRV #1027 had the third water flooding but SGRV still refused to resolve the life threatening problems. (Responsible Party: SGRV’s Scott Green)

20.  10/10/09 – SGRV ignored Carol’s 10/10/09 MAINTENANCE REQUEST to fix her leaky moldy sink. (Responsible Party: SGRV’s Scott Green)

21.   10/13/09 – SGRV’s attorney, Scott E. Williams, created an unauthorized STIPULATION AGREEMENT for George Kieffer, Fairall’s renter, which forgave him of all past due rent and all damages to the Fairall rental house. The Fairall attorney, Mark Tucker, had stolen $740 from the Fairall checking account on 10/08/09 and signed the unauthorized agreement. This agreement prevented the recovery of $9,999.99 from our 8/25/10 Fairall v. Kieffer/Olach #CC2010-038651 Trial for nonpayment of rent and damages to our property. 22.  10/16/09 – SGRV’s employee George Kieffer vacated the Fairalls’ Sun City West rental house and left the rental house keys at Scott E. Williams’ Scottsdale office. The Fairall house had $18,000 of damages and the electrical box was wired to start a fire. (Responsible Parties: SGRV’s Scott Green and attorney Scott E. Williams)

23.  10/20/09 – SGRV’s lawsuit #CC2009-610571 against Carol went to Trial. Since Carol was in the hospital and her attorney failed to appear at the trial a Default Judgment was awarded for $2,568.35. (Responsible Parties: SGRV’s Scott Green and attorney Scott E. Williams)

24.  10/20/09 – SGRV’s Carolyn Duncan informed Mark that SGRV’s Scott Green was about to have him arrested for trespassing. Mark move back to his dangerously damaged house in Sun City West. (Responsible Parties: SGRV’s Scott Green)

25.  10/23/09 – SGRV ignored Carol’s and Mark’s 10/23/09 LANDLORD STATUTORY VIOLATIONS LETTER stating that SGRV failed to maintain a safe and healthy place to live, that SGRV failed to provide essential services, and that SGRV had illegally conducted Landlord Retaliation. 26.  11/10/09 – SGRV DEMAND LETTER for $3,484.05 written to Catherine Reinertson and Mark Fairall threatening an extortion lawsuit for breaking their lease early. (Responsible Party: Scott E. Williams and attorney Scott E. Williams)

27.  12/24/09 – SGRV filed a the baseless lawsuit #CC2009-73227 against Catherine Reinertson and Mark Fairall for the nonpayment of one month for their SGRV #1017 apartment. Catherine Reinertson settled the SGRV extortion for $3,000 in January 2010. Catherine Reinertson, Mark’s 93-year old aunt, passed away on 5/2/11 a broken and sad abused and exploited senior. 28.  07/8/10 – SGRV’s attorney blocked the recovery of our stolen property in our lawsuit #2010-038658 against SGRV which was caused our property recovery loss of $9,999.99. SGRV filed a Baseless Counterclaim Lawsuit with an illegal second lawsuit for the Nonpayment of Rent on Carol’s one lease. SGRV was awarded $9,999.99 plus attorney fees/costs. This was an illegal double satisfaction on one debt that exceeded the count limits. SGRV filed a Baseless Counterclaim Lawsuit against Mark for the Interference of a Contractual Relationship. SGRV was awarded $0 but found Mark responsible for Scott E. Williams’s excessive attorney fees of $5,240.00. (Responsible Parties: SGRV’s Scott Green and Scott E. Williams)

29.  08/10/10 – SGRV’s attorney, Scott E. Williams, illegally placed two liens for $5,240.00 on our house property for his legal fees. (Responsible Party: Scott E. Williams)

30.  09/24/10 – SGRV’s attorney, Scott E. Williams, attempted to derail our 10/2/10 marriage with a Judgment Debtor’s Hearing just before our wedding. The hearing had two armed policemen with no court representation as a show of force by Williams. (Responsible Party: Scott E. Williams)

31. 12/5/10 – SGRV’s attorney, Scott E. Williams, subpoenaed Mark’s former employer, Bank of America, for all records. (Responsible Party: Scott E. Williams)

32.  3/28/11 – SGRV’s attorney, Scott E. Williams, illegally garnished Carol’s checking account which is only funded by her Disability Social Security. (Responsible Party: Scott E. Williams)

33. We had SGRV employees constantly knocking on our door and delivering 20 letters of communication and harassment in September and October 2009. (Responsible Parties: SGRV’s Scott Green and attorney Scott E. Williams)

34. We had our credit ruined by SGRV’s baseless lawsuits which results in the constant bill collecting phone calls, refusal of credit approvals, and countless collection letters. (Responsible Parties: SGRV’s Scott Green and attorney Scott E. Williams)

36. Attorney Scott E. Williams totally misused the legal system with Baseless Lawsuits supported by lying scripted witnesses, false evidence, and a phony mold report. SUMMARY

My wife, Carol A. Buck, and I, Mark Fairall, have been fighting a senior living facility that abused us and financially exploited us for over three and one-half years. We met at Sun Grove Resort Village (SGRV) in January, 2009, and fell in love. I tell everyone that I met an angel in Hell. We moved from SGRV on 10/20/09 because SGRV was not a healthy and safe place to live because of the toxic mold. Also SGRV’s manager, Scott Green, stopped the delivery of Carol’s medication and gave the key to a SGRV employee, George Kieffer, who we had an Injunction against Harassment approved because he had threatened to kill us. We married on 10/02/10, but she is facing the rejection of her transplanted liver due to her exposure to toxic mold at SGRV. Our three dogs passed away due the SGRV toxic mold. 

Now Carol’s transplanted liver rejection blood work show her liver rejection is at the critical stage of fourteen times 

higher than normal.

I moved into Sun Grove Resort Village in 2007 with my 93-year old aunt, Catherine Reinertson. Carol moved into SGRV in the beginning of 2009. I previously had a stroke in 1992 and suffer seizures. Carol is a 2007 post-liver transplant patient. We were all sold on SGRV’s advertised and promised medical services and staff, but they were all lies. The senior living facility was not a properly licensed assisted living facility, and the nurse was an impostor nurse, Claudia Marquez, who was previously cited in 2005 by the Arizona Board of Nursing. 

I was the chairman of the residents’ committee which handled complaints from the residents living at Sun Grove Resort Village with SGRV’s manager, Scott Green. Since I had been a bank vice-president and on the Better Business Bureau Board, I was able to assist the senior residents file complaints with the proper state governmental agencies because of increasing problems at SGRV. I was forced to resign from our SGRV Ambassador Committee Chairmanship in a meeting when we discussed the health concerns of the SGRV Residents. SGRV was renting to new residents with highly infectious diseases such as MRSA and TB. 

SGRV was putting their Residents at risk 

because of poor living conditions, declining food quality, 

and the exposure to highly infectious diseases.

Scott Green retaliated at us for filing complaints 09/13/09 to HUD and the Arizona Attorney General for Fair Housing Rights Violations, False Advertising, and Dangerous/Unsafe Living conditions. Scott Green withheld essential services by:  refusing to fix a cable run through a window opening which prevented locking the SGRV apartment, refusing to remove mold from our SGRV apartment, and even refusing the delivery of Carol’s medication. Scott Green and his attorney, Scott E. Williams, ignored our and our attorney’s written requested for a Reasonable Accommodation Request to allow the delivery of Carol’s medication. Scott Green sued us several times for breaking our leases early. We now have nearly $18,000 worth of wrongful illegal judgments against us from Baseless Lawsuits.

Scott Green forced my aunt to move because she was related to me. He attacked her when he: refused to fix her air conditioning unit, forced her to move early, threatened her with jail time, and extorted $3,000 from her. Catherine Reinertson passed away last year a very sad and broken woman.

We saw 58 senior abuse and senior financial exploitation

cases at Sun Grove Resort Village and 34 seniors died 

with no justice from Arizona.

We discovered that Scott Green was a 2005 Medicare Fraud Felon because he filed nearly 2,700 false Medicare claims totaling $70,000. Scott Green continued to scam seniors with false advertising and baseless lawsuits for eight years at Sun Grove Resort Village until he was fired on 08/28/12. We and others have reported SGRV’s criminal activities to the Peoria Police, Arizona Attorneys General, HUD, and the Maricopa County Attorney but they never properly investigated the senior abuse and financial exploitation at SGRV. We even had to hire our own Private Investigator, Jacob Mueller, to interview the abused seniors before they died since the Law Enforcement Agencies failed to interview our SGRV witness victims. 

We have asked the FBI, Department of Justice, U.S. Senators

Some of our Facebook Friends have asked what exactly did Sun Grove Resort Village (SGRV), Scott Green, and SGRV's attorney Scott E. Williams do to us? We have attached the TIME LINE of the illegal Landlord Retaliation for our filing Fair Housing Complaints.

Still today we are receiving obscene and inflammatory comments to our Internet Postings, articles, and Facebook. We believe that is the work of SGRV's attorney Scott E. Williams because we have a BAR COMPLAINT filed against him for aiding a FELON (Scott Green) abuse and defraud us and other SGRV seniors. Scott Green is unable to continue to HARASS us because he is in JAIL. 

 

The picture is our return Certified Mail that SGRV's Scott Green never accepted. The Certified Mail was our 10/23/09 Statutory Violations letter which stated that we had moved because SGRV failed to maintain a safe and healthy place to live, SGRV had failed to provide essential services, and that SGRV had illegally conducted Landlord Retaliation.
