THE NEWEST SENIOR SCAM - TELEMARKETING SENIOR LIVING CENTERS

THE NEW ELDER CARE REFERRAL AGENCY PROBLEM

The new questionable senior service is the Elder Care Referral Agency (ECRA). The ECRA problem is caused by the misuse of internet advertising, hard sale telephone marketing, and duping seniors. The ECRAs’ goal to make huge profits by finding seniors living facilities and moving the seniors into those referred places. ECRAs have exploded in usage in the past ten years and now represent a $125 million industry. ECRAs are responsible for over 25% of the entire senior living facility placements. It is estimated that in the next two years over 50% of the entire senior living facility placements will be by ECRAs.

ECRAs receive a bounty (referral fee) for the placement of people in senior living centers. They can receive ½ month to $6,000 per placement with the average being $3,500 per person. This is the new sweat shop of hard selling telemarketers that are defrauding seniors. Thousands of ECRA Sales Representatives work only by 100% commission and receive an average of $650 per placement. They usually have no inspections of the senior living centers being referred and have no understanding of geriatric needs. The seniors are usually placed in the senior living center that offers the highest fee placement payment (bounty). Some of the ECRA problems that seniors are complaining about are: aggressive telephone sales calls (up to 45 calls a month), being placed in substandard senior living facilities, and the Double Dipping of senior sales which move the seniors from one senior living facility to another several times a year.

The largest ECRA is “A Place for Mom” which is in 45 states and has the annual sales of $50 million. A Place for Mom has 300,000 website visitors annually, 50,000 requests for placement assistance, 18,000 senior housing facilities, and 430 sales agents. Washington State just passed the ECRA REGULATION LAW which went into effect this year which forces full disclosure of ECRA fees, properly trained ECRA advisors, inspection of the 18,000 senior living faculties, and ECRA insurance coverage. We have purposed the same ECRA law along with 14 other senior protection laws in order to protect Arizona seniors from abuse and exploitation.

The Federal Bureau of Investigations, National White Collar Crime Center, and the Bureau of Justice Assistance have formed a partnership called the IC3 which investigates Cyber Crime. The primary Cyber Crime (internet fraud) is to seniors for the non-delivery of goods and services for health related products and services. The IC3 reported that it had 275,000 complaints in 2011 and that the internet complaints are growing 33% a year. IC3 reports that $264 million is lost by seniors due to internet fraud annually.

Seniors need to be aware that they are desired targets of crooks. The crooks biggest weapons are the internet and phone. We recommended in our recent senior abuse and exploitation class to have “Caller Identification” on their phone and not to answer the phone from callers that they do not know. Seniors need to be aware that nothing is free and that the best way to avoid senior abuse and fraud is by prevention. Abused Dying Senior Protecting Others

DYING SENIOR PRESENTS ELDER ABUSE PREVENTION CLASS

Carol Fairall teaching seniors how to avoid being victims
of elder abuse at PORA Adult Learning Center in
Sun City West, Arizona.
Carol and Mark Fairall presented HELP STOP SENIOR FINANCIAL EXPLOITATION on 10/22/12 at a senior center located in Sun City West to fellow seniors, senior assistance agencies, politicians, and press. The Fairalls goal is to prevent the elder abuse that happened to them from happening to others. They have been fighting their old landlord who refused to fix her leaky moldy sink and stopped the delivery of Carol’s medication in retaliation to their filing complaints with Arizona and Federal officials. Carol’s exposure to the toxic mold started the rejection of transplanted liver and she will die like our three dogs died due to liver cancer. The local newspaper, Daily News Sun, printed “Seminar Tackles Elder Abuse” as the lead story on 10/23/12.

The Fairalls reported in the class that they took 46 senior abuse cases to the Police, Arizona Attorney General, and Maricopa County Attorney but nothing was done to stop the senior abuse and 25 seniors died during that time. The landlord filed baseless lawsuits against seniors who moved because they did not receive the medical help as advertised and promised. The Arrowhead Justice Court rubber stamped guilty on all the lawsuits against former residents and defrauded them of nearly $100,000. The senior living facility is a part of the Oakdale Heights/AREI Ponzi scam which is going to trial 1/2/13, it defrauded $250 million from 2,000 investors. The senior living faculty in Peoria, Arizona, was purchased by 19 out-of-state investors who lost $4.5 million on their investment. The investors break many laws in order to keep the property funded and operating. The long range goal to sell the 30+ year-old, 86-unit, and dilapidated property ASAP.

The corrupt Justice of the Peace Judge, Melanie Deforest, helped defraud the seniors.  It was just discovered that Deforest lied about her education, previous jobs, and failed to complete the required three-week training to be an Arizona Judge. Deforest has pulled out of the election but she is refusing to resign while she is taking a personal leave which is costing the state in $40,000 in her salary and replacement salaries.  All of the Fairalls’ warning communications with the Maricopa County Board of Supervisors and Superior Court about Deforest’s incompetence, biasness, and rudeness were ignored. The Fairalls have $18,000 of baseless judgments because they did not break the lease but the facility broke the lease by withholding services.

The Fairalls showed the class the “smoking gun evidence of 11 false internet advertising contracts” which are illegally posted and duping seniors on the internet. The illegal contracts have the attorney for the landlord Scott E. Williams’ Bates stamp on them which is hard proof that Mr. Williams supports the senior living facility's illegal activities and aides the senior fraud by filing baseless lawsuits. The Fairalls informed the class that the reason the Arizona Officials look the other way is because Mr. Williams was hired by the Maricopa County Board of Supervisors to represent the Maricopa County Politicians on election matters and lawsuits. This is a massive cover-up of Arizona politician corruption, crook protection, and profiteering from seniors. She reported that she has filed complaints with Senator McCain, President Obama, FBI, HUD, and the DOJ and is still waiting for three years for any justice.

Finally, the Fairalls reported in the seminar that they discovered that the landlord was a 2005 Medicare Fraud Felon and that he was terminated in August. The Fairalls’ actions ended Scott Green’s eight-years of senior abuse and fraud at Sun Grove Resort Village. The Fairalls’ actions are helping seniors protect themselves from elder abuse and senior financial exploitations. The Fairalls are busy with the Arizona lawmakers writing new senior protection laws. Carol’s last goal is to appear before the US Congress and inform the federal lawmakers that “A senior is being abused every five seconds” and to fully fund the Elder Justice Act which would help curb this Crime of the 21st Century-Elder Abuse. She will be dead like the rest of the abused senior victims of Sun Grove Resort Village before any justice is achieved.

Carol my wife of only two years is my hero. She is making a difference in helping and protecting other seniors.  She will die as another forgotten victim of elder abuse and financial exploitation with no Justice from Arizona.

A FELON LANDLORD AND DISHONORABLE JUDGE

A  FELON LANDLORD AND DISHONORABLE JUDGE

The ARIZONA REPUBLIC NEWSPAPER revealed in the 10/07/12 article “Maricopa Judge Drops Election Campaign Amid Scrutiny” that Maricopa County Justice of the Peace, Melanie Deforest, has withdrawn from her Arrowhead Court Election campaign. Deforest does not have her University of Utah bachelor’s degree and Arizona State University master’s degrees in criminal justice. We have requested from the Superior Court and Maricopa County Supervisors that she needs to be immediately removed from her JP position, all that all her decisions need to be reviewed, and that she is prosecuted for criminal fraud.

We were subject to her incompetence in our 7/8/10 trial. Our former landlord, Scott Green, falsely advertised that the senior living facility, Sun Grove Resort Village, was a licensed assisted living facility with a nurse and sued us several times. Sun Grove’s manager, Scott Green, refused to fix our apartment’s leaky moldy sink and refused the acceptance for delivery of Carol’s mediation in retaliation to our filing complaints with governmental officials. We know of ten other baseless lawsuits where he sued his former residents when they moved because he could not provide the advertised and promised medical services. It has been discovered that Scott Green is a 2005 Medicare Fraud Felon from Boston. Mr. Green filed over 2,600 false Medicare claims for services that he did not provide. Scott Green abused and defrauded seniors at Sun Grove Resort Village for nearly eight years until he was recently fired in August, 2012. Deforest ruined our credit and cost us money, effort, and time fighting baseless lawsuits from a crooked landlord. My wife is dying due to her transplanted liver rejection caused by her exposure to mold in her apartment.

We have sent extensive new evidence concerning our elder abuse and senior financial exploitation that we suffered by Sun Grove Resort Village. The Maricopa County Attorney, Bill Montgomery, has asked Peoria Police Chief, Roy Minter Jr., to reopen our elder abuse claim #-1-10-007447 that we filed on 05/31/10 against Sun Grove Resort Village. We have spoken to Peoria Police Chief, Roy Minter Jr., and he is reexamining our claims of Sun Grove Resort Village’s elder abuse, false advertising, and an imposter nurse. We explained to Chief Roy Minter Jr. that we know of 46 senior abuse cases at Sun Grove Resort Village and 25 seniors have gone to their graves without justice. One of the victims was our deceased 94-year old aunt, Catherine Reinertson, who was forced to move, was abused by the withholding essential service of air conditioning unit repair, and was defrauded of $3,000 with a baseless lawsuit. Mrs. Reinertson died last year a broken and sad woman caused by elder abuse and senior financial exploitation.

We are trying to protect other seniors from elder abuse with needed information to avoid being a victim of this Crime of the 21st Century. HELP STOP SENIOR FINANCIAL EXPLOITATION is scheduled for 10/22/12 from 1:00 PM to 3:00 PM at the PORA Adult Learning Center located at 13815 Camino del Sol, Sun City West, AZ 85375. Seating is limited so RSVP at (623) 584-4288 extension #415.

INFORMATION CONCERNING OUR ELDER ABUSE PREVENTION CLASS

I MET AN ANGEL IN HELL

Senior Financial Exploitation has been called the Crime of the 21st Century. A senior is abused every five seconds in the United States. My wife and I have been fighting a senior living facility that abused us and financially exploited us for over three years. We met at Sun Grove Resort Village in January, 2009, and fell in love. I tell everyone that I met an angel in Hell. We married on October 2, 2010, but she is facing the rejection of her transplanted liver due to senior abuse. We are presenting an elder abuse prevention class on October 22nd at the Sun City West PORA Adult Learning in order protect seniors from the abuse we suffered. The class will inform the seniors on the scope of elder abuse, the top 10 senior scams, 15 tips to avoid being a victim of elder abuse, and 14 new senior protection law ideas. The state legislators who are interested in protecting seniors will be in attendance, and our private investigator will speak about the need to do background checks on caregivers. The emphasis of the HELP STOP SENIOR FINANCIAL EXPLOITATION event will be education and prevention, which are the keys to stopping elder abuse. The class is scheduled from 1 PM to 3 PM on 10/22/12 at the PORA Adult Learning Center located at 13815 Camino del Sol, Sun City West, AZ 85375. Seating is limited, so RSVP as soon as possible at (623) 584-2488 ext. #415.

I was living at Sun Grove Resort Village with my 93-year old aunt a year before Carol moved there in January, 2009. I had a stroke and suffer seizures while Carol is a post-liver transplant patient. We were sold on the senior living facility’s advertised/promised medical services and staff, but they were all lies. The senior living facility was not a properly licensed assisted living facility, and the nurse was an imposter nurse who was previously cited in 2005 by the Arizona Board of Nursing. I was the chairman of the residents’ committee which handled complaints from the senior residents living at Sun Grove Resort Village with the manager, Scott Green. Since I had been a bank vice president and on the Better Business Bureau Board, I was able to assist the senior residents file complaints with the proper state governmental agencies. I was forced to resign from the residents’ committee due to landlord retaliation of withholding essential services. When I notified Scott Green that I was moving, that Carol and I were getting married, and that we had filed complaints with officials, then all Hell broke loose.

Scott Green withheld more essential services such as refusing to fix our air conditioning unit, refusing to remove mold from our apartment, and even refusing the delivery of Carol’s medication. Scott Green sued us several times and we have $18,000 worth of wrongful judgments against us from baseless lawsuits. Green forced my 94-year old aunt to move, threatened her with jail time, and extorted $3,000 from her. She passed away last year a very sad and broken woman. Carol is now rejecting her transplanted liver due to her mold exposure, and she will die like our three dogs died because of their exposure to the mold. We saw 46 senior abuse/financial exploitation cases at Sun Grove Resort Village and 25 seniors died with no justice. We just discovered that Scott Green is a 2005 Medicare Fraud Felon because he filed over 2,600 false Medicare claims. Scott Green continued to scam seniors with false advertising and baseless lawsuits for eight years at Sun Grove Resort Village until he was recently fired in August, 2012. We also know that the judge who perpetuated that senior financial exploitation criminal activity, Melanie Deforest, lied about her college degrees and is no longer running for the Arrowhead Justice of the Peace position. We have asked the FBI, Department of Justice, Senator John McCain, and President Obama for help in getting Justice for seniors living in Arizona.

OUR JUDGE, MELANIE DEFOREST, IS A FRAUD

“MARICOPA JUDGE DROPS ELECTION CAMPAIGN AMID SCRUTINY”
ARIZONA REPUBLIC NEWSPAPER – 10/7/12

The ARIZONA REPUBLIC NEWSPAPER revealed in the 10/07/12 article “Maricopa Judge Drops Election Campaign Amid Scrutiny” that Maricopa County Justice of the Peace has withdrawn from her Arrowhead Court Election campaign. It was discovered that Deforest does not have the college degrees she claims and that she embellished her previous job experiences. Deforest does not have her University of Utah bachelor’s degree and Arizona State University master’s degrees in criminal justice. Deforest withdrew from the JP race and stated: “I cannot provide (college transcripts) in a timely manner and I would rather focus more on my family than politics at this time.”  The universities have verified that Deforest does not have the degrees she claims. The Maricopa County Justice Court and Maricopa County Supervisors did not verify her past job and academic credentials. Lester Rosen, chief executive of Employment Screening Resources of San Francisco stated: “If job seekers are dishonest as they seek work, there’s a possibility that same characteristic would surface as an employee.” Maricopa County Board of Supervisors spokesman Richard de Uriarte stated: “It is disappointing that in her subsequent comments that she might have inflated her credentials. All you have in this life is your word.” Melanie Deforest stated she plans to remain until another justice of the peace takes office and then she will return to Utah with her children and family. On 10/05/12, Maricopa County Officials removed Deforest’s biography from the county justice court website.

Melanie Deforest needs to be immediately removed from her JP position and prosecuted for fraud. All her decisions need to be reviewed. We were subject to her incompetence in our 7/8/10 trial. We sued our former landlord, Sun Grove Resort Village, to recover illegally collected service dog fees, loss of our apartment upgrades, a stolen countertop from our rental home, and the penalty allowed by law for withholding essential services. Sun Grove countersued us for the non-payment of rent and Contractual Interference. We lost and Sun Grove won. We now have $18,000 of wrongful judgments for baseless lawsuits from Arrowhead Court.

Deforest was grossly biased to the Sun Grove lawyer, Scott E. Williams, who is also a part-time JP Judge in the East Mesa JP Court. Mr. Williams was representing returning JP judge Lex Anderson on an election issue at the same time of our trial. Deforest refused our motion for a change to an impartial venue and refused to allow us to have a jury trial. Deforest threw out our evidence even through the police requested us not to disclose it until pretrial, which never occurred, even when the court clerk said that was no problem. Deforest failed to understand the lawsuit, refused to allow us to cross examine a witness who was threatening to kill us, refused to delay the trial when our witness was in a coma in the hospital, and failed to follow proper courtroom procedures and protocols. Deforest ruled against us and even awarded Sun Grove a double satisfaction judgment on a baseless lawsuit. All Appeals and a Fraud of the Court Motion have failed since the court lost or destroyed the only trial recording. Our 9/9/10 Complaint to the Commission on Judicial Conduct concerning Deforest’s incompetence, biasness, and rudeness was dismissed.

Our former landlord, Scott Green, falsely advertised that the senior living facility was a licensed assisted living facility with a nurse but that was all untrue. The Arizona Department of Nursing had cited Claudia Marquez as an imposter nurse on 5/25/05 but she still illegally operates at Sun Grove as a nurse. Scott Green sued the residents that moved when they discovered the senior living facility could not deliver the advertised medical services. We know of ten baseless lawsuits in the Arrowhead Justice Court where Sun Grove sued their former residents and received nearly $100,000 in wrongful judgments. It has been just discovered that Sun Grove’s manager, Scott Green, is a Medicare Fraud Felon who pled guilty in 2005 in Boston Federal Court. Mr. Green filed over 2,600 false Medicare claims for services that were not provided, which totaled over $70,000. Mr. Green continued to defraud seniors at Sun Grove for eight years with false advertising and baseless lawsuits. Arrowhead Court allowed the misuse of the judicial system as a court sanctioned senior financial exploitation scam in order to provide operating funds to Sun Grove. The 19 owners of Sun Grove purchased the senior living property in 2006 as an investment property but they lost their $4.5 million investment since it was part of the Oakdale Heights/AREI Ponzi scam. The owners do anything to keep the senior living facility funded so that they can sell the property in order to recover some of their losses. Deforest did not understand Sun Grove’s history and refused it to be presented in our opening statement. Justice died in Deforest’s courtroom.

The tragedy of the story is that Deforest ruined our credit and cost us money, effort, and time fighting baseless lawsuits from a crooked landlord. We don’t have much time since the toxic mold in our Sun Grove apartment, which Scott Green refused to fix, has started the rejection of my wife’s transplanted liver. She will die of liver rejection caused by the toxic mold like our three dogs died of the same thing. Carol’s last wish is to protect other seniors from elder abuse and senior financial exploitation so we are teaching HELP STOP SENIOR FINANCIAL EXPLOITATION at PORA Adult Learning on 10/22/12. Carol wants to protect seniors from what happened to us. We are presenting 15 tips on how to protect yourself from elder abuse and financial exploitation. The answer to stopping elder abuse is education and prevention. We are having our lawmakers come to class since we are presenting 14 new Arizona senior protection laws. One of the laws we are requesting is to require a Justice of the Peace to be a lawyer, which is now in 33 other states. Deforest is the poster-girl why this law needs to be in place. Deforest was unqualified to be a JP, she was an aerobics instructor, and she was given the part-time JP judge job as a political gift because her policeman husband was shot on the job. It is time for Arizona to join the 21st Century with qualified JPs and to end the present “Good-Old-Boy” reward Justice of the Peace system.

LETTER TO THE EDITOR

Editorial
We are inviting everyone to the free HELP STOP SENIOR FINANCIAL EXPLOITATION Presentation on October 22nd from 1 PM to 3 PM to be held at PORA Adult Learning. We are abused and exploited seniors who have been fighting for our rights and for other seniors’ rights for over three years. Our efforts have been recently rewarded by the discovery that our former slumlord is a Medicare Fraud Felon. His termination has stopped him from continuing to abuse and exploit more seniors. Unfortunately, he was allowed to harm seniors for nearly eight years at a local senior living facility.

Our Presentation will include the 10 top senior scams and 15 tips to avoid being a victim of elder abuse. We have just presented 14 ideas to our state representatives to improve and add to Arizona’s senior protection laws. Many of our state and federal lawmakers will be available at the presentation to listen to your senior protection law ideas. Senator John McCain, who is helping us with our HUD Complaint, has been very instrumental in obtaining many of the handouts for this presentation. Our elder abuse private investigator, Jacob Mueller, will also be speaking at this presentation concerning the need of background checks on the in-home caregivers. The purpose of this presentation is to try to eliminate the criminal activities of elder abuse through education, prevention, and stronger senior protection laws.

Senior Financial Exploitation has been called the Crime of the 21st Century. Medicare fraud is estimated to be $75 billion a year. If all senior frauds were reported the estimated losses would exceed $130 billion a year. A senior is abused every five seconds in the United States. An average of 900 senior abuse cases, a 43% increase in two years, are being reported monthly to the Arizona Adult Protective Services of the DES. Elder Abuse is an epidemic in our state because Arizona’s growth of reported elder abuse crimes is over three times faster than the national average growth of reported elder abuse crimes.

Seating is limited so please RSVP to this important senior protection event at PORA Adult Learning (623) 584-4288 x 415.

USA v. GREEN

USA v. GREEN

Massachusetts District Court – No. #105-cr-10166DPW
Please click on the link below for the documentation of:  USA v Green – Massachusetts District Court, Case No. 105-cr-10166DPW         http://www.plainsite.org/flashlight/case.html?id=215888

In reviewing the 2005 court documents, I noted the following:

1. Mr. Green devised a scheme to defraud Medicare with Dr. Mitchell Pulver and Dr. Louis Frank, both licensed Psychologists.
2. Mr. Green did not provide treatments to patients and submitted fraudulent claims.
3. Dr. Frank, Dr. Pulver, and Scott Green split the fraudulently received Medicare proceeds.
4. The total Medicare fraud by the three felons was $93,562.87.
5. Mr. Green defrauded Medicare for $70,000.
6. Mr. Green Defrauded National Heritage to pay monies for false Medicare claims and deposited the funds into a checking account Scott Green had opened under the name of “Benjamin Cooper”.
7. Mr. Green admitted Guilt on 5/25/05.
8. Mr. Green’s physician Dr. Jack L. Potts stated that Mr. Green under severe marital, emotional, and financial stress when he committed his crimes.
9. Mr. Green separated from his first wife and entered a twelve-step program to break his addition to gambling.
10. Dr. Potts stated that Mr. Green is likely suffering from Depression, anxiety Disorder, and possibly Embarrassing Panic Disorder.
11. Scott Green’s partner in the criminal activities, Dr. Pulver, told him to stop the Medicare Fraud. Mr. Green showed a complete lack of honesty by misusing the doctors Medicare PIN number without the doctor’s approval.
12. Mr. Green submitted 2,679 false Medicare claims.
13. Mr. Green’s case was considered a Criminal case as opposed to a civil case because of its severity.
14. Mr. Green had his medical records sealed.
15. Mr. Green’s offenses were one count of Mail Fraud and one count of Aiding & Abetting.
16. Mr. Green agreed to the sentence three year probation, six months home confinement with electronic monitoring, and the repayment of $52,622.23.
17. On 12/9/05 Sun Grove Resort Village’s John Paul Taylor agreed to continue to have the felon Scott Green employed as the Executive Director. John Paul Taylor stated on 12/9/05 that Mr. Green had informed him of his legal situation which was nearly a year after Mr. Green first became employed at Sun Grove Resort Village on 12/27/04. This was obviously a violation of Mr. Green’s sentence which was to keep all his employers aware of his felony conviction during his three year probation.
18. Mrs. Green wrote to Judge Woodlock on 8/30/05 pleading for leniency for her husband because: he volunteered delivering meals to homebound seniors, her parents liked him and he helps her parents, he reduced the behavioral problems of the Sun Grove Resort Residents with parties, a resident run bakery, and new equipment purchases. She stated that her husband, Scott Green, could not make it in prison because of his asthma attacks, chest pains, migraines, and depression, and seizures.
19. The Transfer of Jurisdiction for Mr. Green’s sentences was made from Massachusetts to Arizona on 2/17/06.
20. No record is made in the court documents to verify if the Mr. Green ever paid his debt to society.

It is very sad that the felon Scott Green was allowed to continue to work with seniors. He defrauded the seniors in the past and Sun Grove Resort Village (SGRV) gave him the ideal opportunity to continue his past criminal activities. A convicted felon can be bonded but the costs are much higher due to the risk. No convicted felon should ever be in charge of a senior living facility because the risk is more than just stolen money but it is the potential harm to the seniors. The SGRV owners are presently investigating Scott Green for embezzlement. SGRV Owners and Seniority Inc., a subsidiary of ABHOW, are responsible for all SGRV’s illegal activities.

Felon in Charge of Senior Living Facility Terminated

FELON IN CHARGE OF SENIOR LIVING FACILITY TERMINATED
Sun Grove Resort Village - 10134 W. Mohawk Ln. – Peoria, AZ 85382
The Executive Director Scott Green, of the senior living facility Sun Grove Resort Village located in Peoria AZ, has been discovered to be a felon and has been fired. Scott Green pled guilty the Medicare Fraud in 2005 and was sentenced to a $52,622 fine, three year probation, and six months of home incarceration with an electronic monitoring device. Scott Green pled guilty in 2005 for stealing from Medicare $70,000 for false appointments in 1999 to 2000 for senior psychotherapy sessions in nursing homes which never occurred. Sun Grove Resort Village is one of the 21 senior living facilities involved in the Oakdale Heights/AREI Ponzi scam going to Trial in California on 1/2/13. Oakdale Heights/AREI, James Koenig and Gary Armitage, scammed $250 million from 2,000 investors. The 19 Sun Grove Resort Village owners lost $4.5 million in the 30-year old dilapidated 86-unit senior living facility investment, located at 10134 W. Mohawk Ln. Peoria, AZ 85382. The Oakdale Heights/AREI Ponzi scam is the largest Ponzi scam in California’s history.

Mark and Carol Fairall discovered that Scott Green was a wanted criminal while attempting to get their stalled 1,100-day delayed HUD compliant properly enforced. Mr. Green withheld essential services because the Fairalls went to the officials about his criminal activities at the Sun Grove Resort Village. Scott Green retaliated against the Fairalls by: refusing to repair their broken air condition unit, stopping the delivery of Carol Fairall’s medications, and refusing to fix their apartment’s moldy leaky sink. Senator McCain has been assisting the Fairalls by referring their stalled HUD fair housing complaint to the OFFICE OF INSPECTOR GENERAL for the proper investigation, representation, and prosecution.

Scott Green misrepresented Sun Grove Resort Village as a licensed assisted living facility with an available nurse on the property. Scott Green often misrepresented himself as a medical doctor and wrongfully obtained confidential medical information. The Sun Grove Resort Village caregiver, Claudia Marquez, misrepresented herself as a nurse, wrongfully obtained medical information, and often harmed the seniors living there. Ms. Marquez was cited before in 2005 for being an imposter nurse by the Arizona Board of Nursing. No action has been taken on the Fairall’s complaints filed with the Arizona Board of Nursing or Arizona Attorneys General to stop her dangerous and illegal activities. The Fairalls filed complaints with Peoria Police, Maricopa County Attorney, Arizona Attorney General, HUD, FBI, DOJ, and all Arizona senior protection agencies but they all did nothing. The authorities did not interview any of the other 46 abused Sun Grove Resort Village senior residents nor did they discover that Scott Green was a felon. Twenty five of those abused and exploited seniors have passed away during the Fairall’s three year battle without any Justice. Sun Grove Resort Village’s Elder Abuse and Senior Financial Exploitation were allowed to exist for nearly eight years.  It is wrong to have a felon in charge of a senior living facility. A felon can be bonded but it is much more expense because of the risk. The owners and management companies of Sun Grove Resort Village put their senior residents at extreme risk by allowing the felon Scott Green to manage the property.

Mark Fairall’s 94-year old aunt, Catherine Reinertson, passed away after SGRV refused to repair her air condition unit, forced her to move, threatened to jail her, and exploited her for $3,000. She and her executor, Gil Bakke, were told by Scott Green that she suffered this retaliation because she want related to Mark Fairall. She died on 3/2/11, an abused and exploited senior that never saw Justice.

Carol Fairall is rejecting her transplanted liver caused by her exposure to toxic mold which Sun Grove Resort Village refused to eliminate. Sun Grove Resort Village illegally refused the Fairall’s REASONABLE ACCOMMODATION REQUEST FROM A DISABLED PERSON letter and their attorney’s email. Both Scott Green and his attorney refused the delivery acceptance of Carol’s medication and they denied the usage of a clean, dry, and mold-free apartment. Mark and Carol Fairall have not seen Justice. The illegal activities of Sun Grove Resort Village has never been properly investigated, stopped, or prosecuted. Mark and Carol Fairall have suffered constant harassment, extensive health problems, and extreme financial hardships from Sun Grove Resort Village, Scott Green, and Sun Grove Resort Village’s attorney Scott E. Williams.
