We had three veteran
friends abused by Sun Grove Resort Village. They were Cliff Dyrland, Don Monroe
III, and George Grabach. They all have passed away with no Justice from
Arizona.
We have a friend presenting our report to the military today to ask for their help in
fighting elder abuse. It was sad to see our three veteran friends be treated so
badly with no respect for their service to our country. All three of them lost
their limbs fighting for our country but they all died abused, defrauded, and
forgotten.

THE CLIFF DYRLAND ABUSE STORY

THE REAL FACE OF ELDER ABUSE – Cliff
Dyrland – Passed away February 2011 – 63-years old – Cliff was a double
amputee missing both lower legs and used prosthetics. He was a Vietnam Veteran
who worked as contractor in Las Vegas. Cliff was divorced but still loved
his ex-wife and he was survived by his daughter and sister.
Cliff was our primary witness for the Arrowhead Justice Court
for our lawsuit CC2010-038658
against Sun Grove Resort Village (SGRV). Cliff was going
to testify that he, too, was a member of the SGRV’s Ambassador’s Committee and
that he suffered from the retaliation of SGRV’s Scott Green for fighting for
the rights of the other residents by being charged an extra $1,000 a month for
rent. Cliff failed to appear in our 07/08/10 Trial because he was in a
coma in the hospital from an automobile accident. Our Trial’s part-time Justice
of the Peace, Melanie Deforest, refused to delay the trial in order for Cliff
to testify.
THE GEORGE GRABACH ABUSE STORY
THE REAL FACE OF ELDER ABUSE – George
Joseph Grabach – 08/14/32 - 01/17/10 -
George was
a long time Arizonan and a Korean War Veteran, who was an
amputee missing the lower half of one leg. George was married to Ruth Jane Grabach and they made their home for many years in New
River. The Grabachs had two children, two grandchildren, and a great
granddaughter. George was buried at the National Memorial Cemetery with full
military honors. George was another victim of Sun Grove Resort Village’s elder
abuse and senior financial exploitation who died.

George became terminally ill because of respiratory problems, dementia, and Alzheimer’s in October, 2009, and had to move from
SGRV to a skilled nursing home. SGRV’s Executive Director, Scott Green, refused
to remove the second person monthly fee of $425 even when George was in the
nursing home. SGRV’s Scott Green refused to remove the extra monthly fee of $25
for the SGRV parking space even when the George had sold his truck. Scott
Green, and SGRV’s impostor nurse, Claudia Marquez, even posed as a doctor and
nurse and went to George’s nursing home and illegally obtained his medical
records.
Scott Green wrote on the SGRV stationery his 11/13/09 letter to
Ruth Grabach stating: “The
charge nurse informed us that George is stable and would be ready to go home
shortly. George is able to pivot on one foot on his own. I encourage you to
meet with Claudia, the Sunset Care Givers’ nurse to discuss the opportunity to
obtain care assistance via Sunset CareGivers while continuing to live at Sun
Grove Resort Village. It may well be possible and it is Claudia’s opinion
that the Sunset Care Givers can accommodate George’s care assistance
requirements at home.” SGRV broke the
HIPAA Laws of medical privacy, illegally impersonated a doctor and a nurse, and
illegally offered medical opinions by SGRV’s impostor nurse.
Ruth Grabach wrote the Notarized Affidavit on 06/01/10 stating: “Letter dated November 13, 2009,
from Scott Green on official Sun Grove Resort Village Stationery – Subject:
Letter illegally states Claudia Marquez is a nurse which is a Fraud because she
is an Impostor Nurse.” The letter also states Sun Grove will continue to charge
for George Grabach as a second occupant
even though he is in the Nursing Home. Another letter was dated November 22,
2009, Subject: From me to Scott Green complaining that he and Claudia Marquez
went to Brighton Gardens and got confidential medical information on George
Grabach. SGRV’s Scott Green’s reply on his 11/23/09 letter
stated that he was not bound to the Brighton Gardens’ patient privacy policies.
All this documentation was turned over to the Arizona Department of Nursing (who
previously cited Claudia Marquez for being an impostor nurse), Peoria Police, and the Arizona Attorney General for the
prosecution of Scott Green and Claudia Marquez. However, Mrs. Grabach
was never interviewed by any of the Arizona Law Enforcement Agencies, and
nothing was done to stop these illegal SGRV activities. The Arizona Law
Enforcement Agencies failed to discover that SGRV’s Scott Green was a 2005
Medicare Fraud Felon and that he had exploited seniors
since 1999. Scott Green was terminated on 08/28/12 from SGRV. Claudia
Marquez continues to misrepresent herself as a nurse at SGRV. Ms. Marquez
continues to put the seniors at risk with her medicine mistakes, leaving
seniors unattended in their beds for days, and putting them at risk with her
untrained caregiver staff.
Nothing has been
done to stop Claudia Marquez’s law breaking
activities at
SGRV by the Arizona Officials.
THE DANIEL MONROE ABUSE STORY
THE REAL FACE OF ELDER ABUSE – Daniel
Monroe – Passed away Summer 2012 – 63-years old - Dan was an injured
Vietnam Veteran that worked for Ford Motor Company as an engineer. Dan was
divorced, but he had one surviving daughter. We have Dan’s SGRV
elder/vulnerable adult abuse story recorded on 07/15/11 and summarized by our
elder abuse Private Investigator Jacob Mueller. Dan was another victim of SGRV’s
elder abuse and senior financial exploitation who died without any interviews
by any Law Enforcement Agencies. Dan moved to SGRV in January, 2009 and left
after his lease expired in December, 2009. Dan discovered that SGRV was not the
licensed assisted living facility as advertised and Claudia Marquez was an Imposter nurse who refused to care for his medical problems, including MRSA.
Dan stated in our private investigator’s summary: “Mr. Monroe felt that Mr. Green
did not like him due to the fact Mr. Monroe questioned several safety issues
while at Sun Grove. A few of the items that Mr. Monroe questioned Mr.
Green about included, no fire evacuation plan, no certificates in the
elevators, unsafe electrical boxes, improperly installed wiring on the outside
of the building, and the fact that there were residents who bound to
wheelchairs and scooters residing on the second floor which had no other way to
get out in case of fire except by using the elevators.”
Dan was a member of the SGRV
Ambassador Committee which
brought concerns of residents to SGRV management. It was customary for SGRV’s
Scott Green to retaliate against those committee members by withholding
essential services, raising their rent to outrageous amounts, and slandering
them. The following SGRV Ambassador Committee members that experienced this
illegal landlord retaliation for fighting for their fair housing rights and
those of others are: Bill and Dorothy Klink, Ed and Bonnie Hunt, Cliff Dyrland,
Mark Fairall, Roslyn Radden, and Dan Monroe.
SGRV’s Scott Green withheld the delivery of Dan Monroe’s
medication. Dan stated in our private investigator’s summary: “I
questioned Mr. Monroe a little more regarding the refusal of Sun Grove
employees to sign for his medication. Mr. Monroe stated that he would have to
drive the FedEx personally in order to obtain his packages containing
medication that were refused upon delivery by Sun Grove employees. Mr.
Monroe was informed that Sun Grove’s employee would not sign for his insulin or
his narcotics. Mr. Monroe told me that all packages had to go through Sun
Grove’s office, and they would not allow the packages to be delivered directly
to the residents’ apartment. Mr. Monroe said that he had his packages
delivered for several months without any issues. In May, 2009 Scott Green
had told Mr. Monroe that Sun Grove staff was not going to sign for any of Mr.
Monroe’s medications. He also had knowledge that Carol Fairall’s packages were
also being refused for delivery. During that time Mr. Monroe had knowledge that
several of the residents of Sun Grove did not have issues with their
medications being refused for delivery. Mr. Monroe felt that his packages
were possibly being refused due to him standing up for the other residents in
the community at Sun Grove.”
We find it amazing that HUD is ignoring Dan Monroe’s testimony,
our letter to SGRV’s Scott Green requesting a Reasonable Accommodation Request
for a Disabled Person to have Carol’s medication accepted for delivery, and our
attorney’s email to SGRV’s attorney, Scott E. Williams, requesting a Reasonable Accommodation Request for a
Disabled Person to have Carol’s medication delivered otherwise she will die
Demand. SGRV stopped the delivery of Carol’s medication 15 days after we filed
formal complaints against SGRV in retaliation. Felecia Rotellini worked (pro-bono) without success to get
our three year stalled HUD complaint reopened and to prosecute SGRV for Fair
Housing Violations.
Finally, Dan addressed the following problems at SGRV in his
07/15/11 interview:
1. Claudia
Marquez “posed” as a nurse and he thought she was possibly an illegal
immigrant.
2. That a SGRV
resident (Catherine Kielly) was left on the floor for nearly two days because
SGRV’s emergency alarm system was not installed or not properly working.
3. That the SGRV
resident Lena Frei fell out her of scooter (which was caused by sidewalk cracks
and uneven walkways).
4. The SGRV residents were afraid to submit complaints because
they feared retaliation from Scott Green. Dan started an anonymous complaint
box where the SGRV residents could write down their SGRV concerns without their
names being disclosed.
5. That
the SGRV employee Gail (Magnusson) had stolen money from the SGRV residents
($25,000 from Eldon Doll).
6. That the
Fairalls had an unresolved mold problem in their apartment and they were not
allowed to use the SGRV guest apartment (which was a normal procedure when as
SGRV apartment became unlivable.).
7. That the
following SGRV residents were forced to move because of their complaints:
Charles “Pat” Forest, Sally Byers, Norma Schneider, and Pam Klein.
8.
That Sun Grove had financial problems because of issues with SGRV’s employee
paychecks.
Note: These are just a few of the elder abuse and senior financial exploitation stories that were reported in THE SUN GROVE RESORT VILLAGE ELDER ABUSE REPORT. This 82-page report was given to the US Senators Jeff Flake's office and John McCain's office on May 3, 2013. The complete report was mailed to the US Senate Special Committee on Aging.
It is our hope that we have the opportunity to present this story to Congress in order to get the ELDER JUSTICE ACT funded. This has to be done as soon as possible because my wife, Carol, is dying of the rejection of her transplanted live which was caused the elder abuse. SGRV refused to repair the moldy leaky sink which exposed her to toxic mold. SGRV's felon manager Scott Green did this in retaliation for us filing official complaints about SGRV's false advertising, Imposter nurse (Claudia Marquez), and for violation FAIR HOUSING RIGHTS.

A. FAIRALL - MY WIFE AND MY LIFE – ABUSE STORY
CAROL FAIRALL IN THE HOSPITAL FOR THE REJECTION OF HER TRANSPLANTED LIVER CAUSED BY EXPOSURE TO TOXIC MOLD AT SUN GROVE RESORT VILLAGE. |
Carol just received a "Get Well Letter" from President Obama last December (picture of President Obama 12/20/12 Letter). President Obama is very aware that Carol is trying to protect other seniors from what happened to her with her speaking and writing. We just received the 02/05/13 letter from the U.S. Department of Health & Human Services (DHHS) (picture of 02/05/13 DHHS Letter). The letter signed by Edwin Walker, Deputy Assistant Secretary of Aging, commends Carol for her elder abuse prevention class teaching (picture is Carol teaching a class on elder abuse prevention). Mr. Walker works for the Administration of Aging (AOA) which reports to the President the DHHS Secretary, Kathleen Sebelius. The AOA is the federal agency responsible for advocating on behalf of older Americans.
The DHHS letter reports that President Obama asked them to
respond to the important work that Carol is doing in preventing the abuse of
the vulnerable elderly. The DHHS letter states: “We are always
pleased to hear about exceptional individuals, like your wife Carol, who share
our commitment for improving the lives and well-being of older Americans. We
certainly believe that education is the first line of defense in combating the
growing problems of elder abuse, and commend her meritorious efforts in
teaching seniors how to protect themselves against all forms of mistreatment.” I treasure every moment we have together. I
know we all will meet on the Rainbow Bridge together, and we will have eternity
to all enjoy together.
