Arizona ranks 6th in the nation with mold issues according to the GREENGARD ENVIRONMENTAL INSTITUTE (GEI) study. GEI states that mold is caused by water intrusion/leaks and not climate.  The states that have the lowest construction standards have the highest rates of mold problems.

We were exposed to toxic mold at Sun Grove Resort Village (SGRV) which killed our three dogs and started the rejection of Carol’s transplanted liver. Arizona has no RENTERS’ MOLD PROTECTION LAW which was established in California in 2000 to protect renters. We have proposed that law to our state lawmakers.

We will educate you about indoor mold problems and the health problems it causes. We will share our test findings of mold at SGRV and an Arizona test study confirming mold at SGRV.  We wrote letters to the authorities but nothing was done to investigate our allegations of SGRV’s toxic mold problems.  We will share with you the bogus reported SGRV’s lawyer falsified evidence for HUD.  Finally, we will share our damages and the current continuing risk to the SGRV residents.

We urged our FACEBOOK Friends to call your state lawmakers to demand the passage of the RENTERS’ MOLD PROTECTION LAW. According to the US Environmental Protection Agency (EPA) there are approximately 400,000 different types of mold. Nearly 1,000 types of mold are found indoors across America and 80 molds cause illnesses.  The EPA states:

 “Molds reproduce by means of tiny spores: the spores are invisible to the naked eye and float though outdoor and indoor air. Molds have the potential to cause health problems.  Molds produce allergens (substances that can cause allergic reactions), irritants, and in some cases, potentially toxic substances (mycotoxins), inhaling or touching mold or mold spores may cause allergic reactions in sensitive individuals. Allergic responses include hay fever-type symptoms, such as sneezing, runny nose, red eyes, and skin rash (dermatitis). Allergic reactions to mold are common. They can be immediate or delayed. Molds can cause asthma attacks in people with asthma who are allergic to mold. In addition, mold exposure can irritate the eyes, skin, throat, and lungs of both mold-allergic and non-allergic people. “

Molds are classified into three groups based upon how it affects people, they are:
1. Allergenic Molds affects allergies.
2. Pathogenic Molds produces an infection which is deadly to an individual with a compromised immune system, such as a diabetic or an organ transplant patent.
3. Toxigenic Molds causes’ serious health effects in almost everyone because it causes irritation, immunosuppression, and cancer.
TOXIC MOLD SPREADS IN THE AIR
The most common molds found indoors are:
1.  Aspergillus - white color - Mildew
2.  Cladosporium - brown color - Decaying organic matter
3.  Penicillium - green color - Food spoilage
4.  Alternaria - olive color – Rotting caused by water damage
5. Stachybotrys-black color -Fungal Growth caused by water damage

The story is about the Fabry family’s fight with mold in their home and the medical problems it caused for their entire family. Sun Grove Resort Village (SGRV) is a senior living facility located at 10134 W. Mohawk Ln. Peoria, AZ 85382. SGRV was built over 30 years ago. SGRV consists of 11 buildings which hold 86 separate apartments and a main club house/office/restaurant.  In May 2006 the present 20 SGRV owners purchased the property for $4.1 million as an investment from the Oakdale Heights/AREI Ponzi Scam. The SGRV owners had to put an additional $400,000 in capital into their bad SGRV investment in order to keep the senior living facility in operation until they can sell it after the recession.



RESTAURANT PROBLEMS: The Maricopa County Environmental Services has had 13 restaurant inspections of the SGRV over the past three years. The reason for the high number of SGRV restaurant inspections is because of the high number of violations, the high number of complaints, and the fact that SGRV had an unlicensed food server, their gardener, preparing food for the senior residents. In the past three years SGRV had 24 major restaurant violations and 23 (96%) of those violations could have resulted in mold. The egregious SGRV restaurant violations were:  dried food on counter-tops  soiled plates and utensils, refrigerator too warm, door sweep not effective, food not cooked properly, cross contamination problems, leaking plumbing problems, uncovered garbage and toilet, poor employee and kitchen sanitation, and improper cooking utensils. The SGRV seniors and public are at risk of becoming sick or dying because of SGRV’s dangerous restaurant conditions and service. 

GARBAGE BEHIND SGRV
POOL PROBLEMS: The Maricopa County Environmental Services FAILED SGRV’s pool on 12/29/08 for insufficient chlorine. Gil Bakke, nephew to former SGRV resident Catherine Reinertson, stated in his 07/28/11 statement to our private investigator that he had become sick in 2009 with a costly severe skin infection that was caused by SGRV’s improperly treated pool water. The SGRV pool is a health risk.

COCKROACHES AT SGRV
BEAUTY SALON PROBLEMS:  The Arizona State Board of Cosmetology issued the 02/19/10 LETTER OF CONCERN because the SGRV Beauty Salon was: delinquent of the license, it had no TB HIV-1 HEP B kit, it had no first aid kit, and it had no blood spill kit. The SGRV Beauty Parlor is a health risk.

MOLD PROBLEMS: The Maricopa County Environmental Services was called out for a mosquito infestation complaint #310225 on 05/20/11. The inspector found mold in the front SGRV fountain that was causing the mosquito problem.  Our Pro-Lab.SSPTM.Inc. apartment mold study kit found on 10/18/09 unacceptable levels of the molds Bipolaris and Drechslera in our SGRV apartment.  The SGRV property has many problems because it has been poorly maintained for over six years

SUMMATION: The SGRV property has extensive mold problems and dangerous living conditions (bad electrical wiring, obstructed walkways, no emergency alarm system, broken emergency elevator phones, no fire drills, full gas containers behind clubhouse  and a bug infestation). This has been documented by Maricopa County Environmental Services, Arizona State Board of Cosmetology, Pro-Lab/SSPTM, Inc., and notarized/written statements.

The Advanced Mold Inspections.Com states: 

“BIOPLARIS: A widespread fungus that is most frequently associated was grasses, plant material, decaying food, and soil. It is common to both indoor and outdoor environments. Older obsolete names include Dreschslera and Helminthosporium. This fungus produces large spores which would be expected to be deposited in the upper respiratory tract." Various species of this fungus can produce mycotoxin – sterigamatocystin which has been shown to produce liver and kidney damage when ingested by laboratory animals.  

"DRESCHLERA: Conidia (spores) dimensions 40-120 x 17-28 microns. Found on grasses, grains and decaying food. It can occasionally cause a corneal infection of the eye.”

We have testimony from the following people that SGRV had a mold problem, they are:
1.  07/29/11 – John Eggen - son of former SGRV resident Lil Eggen, found mold in his mother’s apt.
2.  11/15/12 – DeDe Stockton - former SGRV Concierge for one year, saw mold in SGRV apartments.
3.  11/24/12 – Fredda Sharp-former SGRV Activities Director for 5 years, saw mold in SGRV apartments.

MISREPRESENTING HERSELF AS A NURSE
Fredda was told by SGRV’s 2005 MEDICARE FRAUD FELON, Scott Green (pictured), to keep the mold problem quiet. SGRV's Executive Director, Scott Green, was terminated on 08/28/12 when it was discovered that he plead guilty to stealing $70,000 in nearly 2,700 bogus Medicare Claims in 2005. The other picture is the impostor nurse Claudia Marquez who misrepresents herself as a nurse. She was cited on 3/25/05 by the Arizona Board of Nursing for misrepresenting herself as a nurse and she continues those illegal activities. Arizona Officials do nothing to stop the illegal false advertising that SGRV is a licensed assisted living faculty while completely ignoring the unsafe conditions of the SGRV senior living property.

The SGRV mold and property problems are extreme health hazards to the residents and public. The SGRV residents need to be evacuated and the SGRV buildings need to be destroyed.

Sun Grove Resort Village’s (SGRV) attorney, Scott E. Williams (pictured) hired a very small inspection company ENVIRONMENT CONSULTING, INC. (ECI) to inspect our SGRV apartment for mold.  The Arizona Corporation Commission records show ECI was incorporated in September, 2008 and did business out of Miranda Mayo’s, the owner, house.  ECI’s Brandon White did the mold test at our SGRV apartment on 10/16/09. He falsely stated that he found no mold in his 10/20/09 ECI mold report.

This mold report was simply a phony mold report that was produced by attorney Scott E. Williams to disprove our nationally known mold inspection company Pro-Lab. SSPTM, Inc.’s positive mold results. ECI was out of business on 02/03/11 because the Arizona Corporation Commission closed the company for nonpayment of their annual dues.  ECI closed BEFORE HUD’s Catherine Ross-Perry verified the authenticity of the ECI mold report on 05/03/11. Also, ECI used the mold lab Tierra Science which had been closed due to inaccurate tests. The ECI mold report has no credibility because it was free, the ECI inspector Brandon White went to work for Scott E. Williams, ECI and Tierra Science Lab were closed, and the inspector Brandon White lied to HUD and the Arrowhead Justice Court.
SGRV MOLD CULTURE

HUD failed to discover that the ECI mold report was phony documentation generated by SGRV’s Felon, Scott Green, and SGRV’s attorney, Scott E. William.

ECI was simply a fly-by-night mold company that had no freestanding business location. ECI was underfunded since Arizona had to close the little over two year business for the nonpayment of its state fees.   ECI’s Brandon White reported in his 05/03/11 HUD interview that he gave SGRV a $300 discount because he was late generating the report. That was a lie because the report was completed, sent by email, and mailed by Certified Mail on 10/20/09, which is only four days after the test was done and not the seven days he reported to HUD. Brandon White lied because on 10/22/09 he waived the entire $427.23 ECI mold report fees for SGRV (picture of waived ECI bill).  Finally, Brandon White lied to HUD stating he had no business relationship with Scott E. Williams. Brandon White was hired was hired by Scott E. Williams to be the mold consultant for William’s lawyer group the ASSOCIATION OF LANDLORD ATTORNEYS (ALTA). On 05/06/11 Brandon White spoke before ALTA, which was only three days after his perjurous HUD testimony.

Brandon White (pictured) benefited by producing a free false mold report because he was hired by Scott E. Williams’ ALTA group of 20 attorneys after ECI had closed. According to the Arizona Corporation records Brandon White started his own company Enviroscience Consulting, Inc. According to the Arizona Corporation Commission records Brandon White started his company on 07/14/11, which is only a little over two months after he had lied to HUD. WE SUSPECT SCOTT E. WILLIAMS ENABLED BRANDON WHITE TO START HIS OWN COMPANY. We suspect that was done to hide the fact that SGRV was and is full of mold and it is a very dangerous and deadly property.
ECI BILL TO SGRV - FREE "PHONY" MOLD INSPECTION
We believe SGRV’s Felon, Scott Green, and SGRV’s attorney, Scott E. Williams, had several SGRV employee lie to HUD.  We believe the SGRV employees were coerced and coached by Scott Green and Scott E. Williams under the threat of losing their jobs. We have testimony from former SGRV employees, Fredda Sharp and DeDe Stockton, which states the SGRV employees were forced to lie in order to keep their jobs. We heard the same witness tampering story from SGRV Giorgio Morabito when he refused to testify at our trial. Giorgio Morabito called us the night before our trial and begged off testifying because he was told by Scott Green if he did he would be fired. Witness tampering threats was used by both Scott Green and Scott E. Williams to scare off our witnesses.

WATER LEAK & MOLD AT SGRV
We have pictures of the SGRV water leaks which prove the untruthfulness of the SGRV employees.  Also, we have Carol’s medical records book that was stored under the SGRV bathroom sink where the leaks occurred. The pictured book is full of mold and it is now stored in a plastic bag. This book is hard evidence that we were exposed to toxic mold at SGRV. 

We both now have severe medical problems and we will die sooner because our exposure to SGRV’s TOXIC MOLD.

We reported these illegal activities to Senator John McCain when we requested an OFFICE OF THE INSPECTOR GENERAL investigation of HUD fraud. We have supplied all our documentation and evidence to Senator McCain and our attorney Felecia Rotellini in order to reopen our 3+ year stalled HUD COMPLAINT and to prosecute SGRV for fair housing violations.
