Subject: Elder Abuse in Arizona

Dear U.S. Senator Jeff Flake: 

We need your help in getting our elder abuse story to the United States Special Committee on Aging which you are a member. I am aware this is the proper channel to go through with our elected Senator first, which I am doing. I have contacted you in the past and but received no reply. Our elder abuse story can no longer be ignored and will soon receive state and national press because of an 82-page report that I just completed and sent the Press concerning Sun Grove Resort Village (SGRV), located in Peoria, Arizona.

I listed the important points why this elder abuse story will soon receive extensive news media coverage, which are:

1.  It is one of the properties involved in California’s largest Ponzi scheme, AREI/OAKDALE HEIGHTS. This Ponzi defrauded 2,000 investors of $250 million and is presently being tried in Shasta County Court located in California.

2.  The SGRV owners live out-of-state and lost $4.5 million on the property investment and ran it into the ground the past six years. The SGRV property is dilapidated due to lack of repair and full of toxic mold. The SGRV property is a health hazard should be destroyed to protect the public. Seniors are getting sick on the SGRV property now because of the toxic mold and all the illegal activities continue with the abusing and defrauding SGRV seniors.

3.  The former SGRV manager, Scott Green, was a 2005 Medicare Fraud Felon and the local law enforcement never discovered his criminal record when complaints were made by SGRV resident victims. Scott Green was terminated from SGRV on 08/28/12 because he was suspected of embezzlement by the SGRV owners.

4.  We discovered Scott Green forged an employment verification letter to the court that kept him out of jail in 2005. The DOJ Washington is actively investigating his illegal court forgery and senior abuse.

5.  We have attempted to protect the public with classes about senior abuse and fraud. We are certified by the Ageless Alliance and National Center on Elder Abuse as speakers in this area. I have just received the Honored Lifetime Membership of the COVINGTON’S WHO’S WHO for my elder abuse prevention efforts. Our classes are well attended and have been covered by the DAILY NEWS SUN newspaper.  We have presented our PowerPoint to churches, clubs, civic organizations, rest homes, senior living centers, and senior education centers.

6.  We are working to change state and national laws to better protect seniors. We proposed 15 new laws this session in Arizona but only one was passed this year. We have a presenter going to the next U.S. Congress Senate Hearing on Elder Abuse. Carol has received letters from President Obama thanking her and wishing her well.

7.  We have had the help of Felecia Rotellini (for free) and Senator John McCain to get HUD to approve our fair housing complaint but HUD is presently not functioning properly.

8.  Since the media has ignored the SGRV and elder abuse problem we used the social media, Facebook, to inform the public of the problems. Our Facebook has grown to over 1,150 Friends is just three months with extremely influential people following it.

9.  The SGRV attorney, Scott E. Williams, was hired by the Maricopa County Board of Supervisors to represent the Maricopa County officials and politicians on election matters so he is “Protected.” Our Court records and recordings disappear and the Bar ignores our complaints against Scott E. Williams and Mark Tucker.

10.  The FBI is investigating our complaint against Arizona Attorney General, Tom Horne, for selective prosecution in his protection of Scott E. Williams.

 I posted this story in my Facebook in April and received thousands of “Hits” and many expressed concerns why Justice does not exist in Arizona for abused seniors.

My wife, Carol A. Buck, and I have been fighting a senior living facility that abused us and financially exploited us for over three and one-half years. We met at Sun Grove Resort Village (SGRV) in January, 2009, and fell in love. I tell everyone that I met an angel in Hell. We moved from SGRV on 10/20/09 because SGRV was not a healthy and safe place to live because of the toxic mold. Also SGRV’s manager, Scott Green, stopped the delivery of Carol’s medication and gave the key to a SGRV employee, George Kieffer, who we had an Injunction against Harassment approved because he had threatened to kill us. We married on 10/02/10, but she is facing the rejection of her transplanted liver due to her exposure to toxic mold at SGRV. Our three dogs passed away due the SGRV toxic mold.

Now Carol’s transplanted liver rejection blood work show her liver rejection is at the critical stage of eleven times higher than normal.

I moved into Sun Grove Resort Village in 2007 with my 93-year old aunt, Catherine Reinertson. Carol moved into SGRV in the beginning of 2009. I previously had a stroke in 1992 and suffer seizures. Carol is a 2007 post-liver transplant patient. We were all sold on SGRV’s advertised and promised medical services and staff, but they were all lies. The senior living facility was not a properly licensed assisted living facility, and the nurse was an impostor nurse, Claudia Marquez, who was previously cited in 2005 by the Arizona Board of Nursing. I was the chairman of the residents’ committee which handled complaints from the residents living at Sun Grove Resort Village with SGRV’s manager, Scott Green. Since I had been a bank vice-president and on the Better Business Bureau Board, I was able to assist the senior residents file complaints with the proper state governmental agencies because of increasing problems at SGRV. I was forced to resign from our SGRV Ambassador Committee Chairmanship in a meeting when we discussed the health concerns of the SGRV Residents. SGRV was renting to new residents with highly infectious diseases such as MRSA and TB.  SGRV was putting their Residents at risk because of poor living conditions, declining food quality, and the exposure to highly infectious diseases.

Scott Green retaliated at us for filing complaints 09/13/09 to HUD and the Arizona Attorney General for Fair Housing Rights Violations, False Advertising, and Dangerous/Unsafe Living conditions. Scott Green withheld essential services by:  refusing to fix a cable run through a window opening which prevented locking the SGRV apartment, refusing to remove mold from our SGRV apartment, and even refusing the delivery of Carol’s medication. Scott Green and his attorney, Scott E. Williams, ignored our and our attorney’s written requested for a Reasonable Accommodation Request to allow the delivery of Carol’s medication. Scott Green sued us several times for breaking our leases early. We now have nearly $18,000 worth of wrongful illegal judgments against us from Baseless Lawsuits.

Scott Green forced my aunt to move because she was related to me. He attacked her when he: refused to fix her air conditioning unit, forced her to move early, threatened her with jail time, and extorted $3,000 from her. Catherine Reinertson passed away last year a very sad and broken woman.

We saw 58 senior abuse and senior financial exploitation cases at Sun Grove Resort Village and 33 seniors died with no justice.

We discovered that Scott Green was a 2005 Medicare Fraud Felon because he filed nearly 2,700 false Medicare claims totaling $70,000. Scott Green continued to scam seniors with false advertising and baseless lawsuits for eight years at Sun Grove Resort Village until he was fired on 10/28/12. We and others have reported SGRV’s criminal activities to the Peoria Police, Arizona Attorneys General, HUD, and the Maricopa County Attorney but they never properly investigated the senior abuse and financial exploitation at SGRV. We even had to hire our own Private Investigator, Jacob Mueller, to interview the abused seniors before they died since the Law Enforcement Agencies failed to interview our SGRV witness victims. We have asked the FBI, Department of Justice, U.S. Senator John McCain, and President Obama for help in getting Justice.

I request a meeting with you or your staff as soon as possible to discuss this problem and give you a copy of the 82-page well-documented elder abuse report. This is my request for your assistance since you are a member of the Special Committee on Aging and that is the proper procedure. Senator John McCain has been very helpful to us in the past and I am copying this email to his office to keep him informed. Please be aware that if I do not hear from you I will contact Senators Bill Nelson and Susan Collins, who head-up the Aging Committee, directly. I want to work with our Arizona elected officials, so please contact me.
