Dear U.S. Senator Jeff Flake: 

We need your help in getting our elder abuse story to the United States Special Committee on Aging which you are a member. I am aware this is the proper channel to go through with our elected Senator first, which I am doing. I have contacted you in the past and but received no reply. Our elder abuse story can no longer be ignored and will soon receive state and national press because of an 82-page report that I just completed and sent the Press concerning Sun Grove Resort Village (SGRV), located in Peoria, Arizona.

I listed the important points why this elder abuse story will soon receive extensive news media coverage, which are:

1.  It is one of the properties involved in California’s largest Ponzi scheme, AREI/OAKDALE HEIGHTS. This Ponzi defrauded 2,000 investors of $250 million and is presently being tried in Shasta County Court located in California.

2.  The SGRV owners live out-of-state and lost $4.5 million on the property investment and ran it into the ground the past six years. The SGRV property is dilapidated due to lack of repair and full of toxic mold. The SGRV property is a health hazard should be destroyed to protect the public. Seniors are getting sick on the SGRV property now because of the toxic mold and all the illegal activities continue with the abusing and defrauding SGRV seniors.

3.  The former SGRV manager, Scott Green, was a 2005 Medicare Fraud Felon and the local law enforcement never discovered his criminal record when complaints were made by SGRV resident victims. Scott Green was terminated from SGRV on 08/28/12 because he was suspected of embezzlement by the SGRV owners.

4.  We discovered Scott Green forged an employment verification letter to the court that kept him out of jail in 2005. The DOJ Washington is actively investigating his illegal court forgery and senior abuse.

5.  We have attempted to protect the public with classes about senior abuse and fraud. We are certified by the Ageless Alliance and National Center on Elder Abuse as speakers in this area. I have just received the Honored Lifetime Membership of the COVINGTON’S WHO’S WHO for my elder abuse prevention efforts. Our classes are well attended and have been covered by the DAILY NEWS SUN newspaper.  We have presented our PowerPoint to churches, clubs, civic organizations, rest homes, senior living centers, and senior education centers.

6.  We are working to change state and national laws to better protect seniors. We proposed 15 new laws this session in Arizona but only one was passed this year. We have a presenter going to the next U.S. Congress Senate Hearing on Elder Abuse. Carol has received letters from President Obama thanking her and wishing her well.

7.  We have had the help of Felecia Rotellini (for free) and Senator John McCain to get HUD to approve our fair housing complaint but HUD is presently not functioning properly.

8.  Since the media has ignored the SGRV and elder abuse problem we used the social media, Facebook, to inform the public of the problems. Our Facebook has grown to over 1,150 Friends is just three months with extremely influential people following it.

9.  The SGRV attorney, Scott E. Williams, was hired by the Maricopa County Board of Supervisors to represent the Maricopa County officials and politicians on election matters so he is “Protected.” Our Court records and recordings disappear and the Bar ignores our complaints against Scott E. Williams and Mark Tucker.

10.  The FBI is investigating our complaint against Arizona Attorney General, Tom Horne, for selective prosecution in his protection of Scott E. Williams.

 I posted this story in my Facebook in April and received thousands of “Hits” and many expressed concerns why Justice does not exist in Arizona for abused seniors.

My wife, Carol A. Buck, and I have been fighting a senior living facility that abused us and financially exploited us for over three and one-half years. We met at Sun Grove Resort Village (SGRV) in January, 2009, and fell in love. I tell everyone that I met an angel in Hell. We moved from SGRV on 10/20/09 because SGRV was not a healthy and safe place to live because of the toxic mold. Also SGRV’s manager, Scott Green, stopped the delivery of Carol’s medication and gave the key to a SGRV employee, George Kieffer, who we had an Injunction against Harassment approved because he had threatened to kill us. We married on 10/02/10, but she is facing the rejection of her transplanted liver due to her exposure to toxic mold at SGRV. Our three dogs passed away due the SGRV toxic mold.

Now Carol’s transplanted liver rejection blood work show her liver rejection is at the critical stage of eleven times higher than normal.

I moved into Sun Grove Resort Village in 2007 with my 93-year old aunt, Catherine Reinertson. Carol moved into SGRV in the beginning of 2009. I previously had a stroke in 1992 and suffer seizures. Carol is a 2007 post-liver transplant patient. We were all sold on SGRV’s advertised and promised medical services and staff, but they were all lies. The senior living facility was not a properly licensed assisted living facility, and the nurse was an impostor nurse, Claudia Marquez, who was previously cited in 2005 by the Arizona Board of Nursing. I was the chairman of the residents’ committee which handled complaints from the residents living at Sun Grove Resort Village with SGRV’s manager, Scott Green. Since I had been a bank vice-president and on the Better Business Bureau Board, I was able to assist the senior residents file complaints with the proper state governmental agencies because of increasing problems at SGRV. I was forced to resign from our SGRV Ambassador Committee Chairmanship in a meeting when we discussed the health concerns of the SGRV Residents. SGRV was renting to new residents with highly infectious diseases such as MRSA and TB.  SGRV was putting their Residents at risk because of poor living conditions, declining food quality, and the exposure to highly infectious diseases.

Scott Green retaliated at us for filing complaints 09/13/09 to HUD and the Arizona Attorney General for Fair Housing Rights Violations, False Advertising, and Dangerous/Unsafe Living conditions. Scott Green withheld essential services by:  refusing to fix a cable run through a window opening which prevented locking the SGRV apartment, refusing to remove mold from our SGRV apartment, and even refusing the delivery of Carol’s medication. Scott Green and his attorney, Scott E. Williams, ignored our and our attorney’s written requested for a Reasonable Accommodation Request to allow the delivery of Carol’s medication. Scott Green sued us several times for breaking our leases early. We now have nearly $18,000 worth of wrongful illegal judgments against us from Baseless Lawsuits.

Scott Green forced my aunt to move because she was related to me. He attacked her when he: refused to fix her air conditioning unit, forced her to move early, threatened her with jail time, and extorted $3,000 from her. Catherine Reinertson passed away last year a very sad and broken woman.

We saw 58 senior abuse and senior financial exploitation cases at Sun Grove Resort Village and 33 seniors died with no justice.

We discovered that Scott Green was a 2005 Medicare Fraud Felon because he filed nearly 2,700 false Medicare claims totaling $70,000. Scott Green continued to scam seniors with false advertising and baseless lawsuits for eight years at Sun Grove Resort Village until he was fired on 10/28/12. We and others have reported SGRV’s criminal activities to the Peoria Police, Arizona Attorneys General, HUD, and the Maricopa County Attorney but they never properly investigated the senior abuse and financial exploitation at SGRV. We even had to hire our own Private Investigator, Jacob Mueller, to interview the abused seniors before they died since the Law Enforcement Agencies failed to interview our SGRV witness victims. We have asked the FBI, Department of Justice, U.S. Senator John McCain, and President Obama for help in getting Justice.

This is my request for your assistance since you are a member of the Special Committee on Aging and that is the proper procedure. SUN GROVE RESORT VILLAGE'S KITCHEN PUTS PUBLIC AT RISK

SUN GROVE RESORT VILLAGE’S  KITCHEN/DINNING ROOM IS DANGEROUS 

On 04/23/13, the Maricopa County Environmental Services inspected the SUN GROVE RESORT VILLAGE (SGRV) kitchen, located at 10134 W. Mohawk LN., Peoria, AZ 85382, and discovered more disturbing dangerous health hazard violations.

They found: Violation ID #53 Physical facilities installed not properly cleaned and maintained. 

Specifically the restaurant inspectors found:                                                                                    

“Wall and coved base under the dish machine in disrepair. Wall appears to have water damage, paint is peeling, and coved base is falling off. Repair is needed.”

SGRV received no rating and the violation found was a Major Core Violation.

Do yourself and your family a favor and protect your family…DON’T EAT AT SGRV!

The Maricopa County Environmental Services has had 13 restaurant inspections of the SGRV over the past three years. The reason for the high number of SGRV restaurant inspections is because of the high number of violations, the high number of complaints, and the fact that SGRV had an unlicensed food server, their gardener, preparing food for the senior residents. In the past three years, SGRV had 24 major restaurant violations and 23 (96%) of those violations could have resulted in mold. The egregious SGRV restaurant violations were:  dried food on counter-tops  soiled plates and utensils, refrigerator too warm, door sweep not effective, food not cooked properly, cross-contamination problems, leaking plumbing problems, uncovered garbage and toilet, poor employee and kitchen sanitation, and improper cooking utensils. 

The SGRV seniors and public are at risk of becoming sick or dying

because of SGRV’s dangerous restaurant conditions and service.

I submitted the attached 05/05/12 Complaint to the IC3 concerning my former living facility, Sun Grove Resort Village (SGRV), for using false internet advertising. I have 11 Elder Care Referral Contracts, which I received in the 07/08/10 Trial Fairall v. SGRV, signed by Scott Green stating the SGRV is a licensed assisted living facility which is untrue. I referred the evidence to Arizona Attorney General Tom Horne but he did nothing because he is protecting SGRV’s lawyer Scott E. Williams who his election attorney hired by the Maricopa County Board of Supervisors. I submitted the attached 05/08/12 Complaint to the FBI against SGRV, Scott E. Williams, and Tom Horne for false internet advertising, elder abuse, senior financial exploitation, and selective prosecution. I have reported the SGRV criminal activity and the Fraud of the Court to President Obama, Arizona Senator McCain, the Department of Justice (open file #JL 30036058).

Scott Green managed SGRV from 12/27/04 to 08/28/12 when he was terminated for suspected embezzlement. The 20 owners of SGRV were not aware of Scott Green’s Felony which was a requirement from the Massachusetts District Federal Court. I have discovered the attached 12/09/05 EMPLOYMENT VERIFICATION LETTER Scott Green submitted to the Court in his Felony Hearing was forged. I have attached the 03/26/13 Attorney Robert M. Hailey letter, who represents John Paul Taylor of Stonegate Senior Living LLC, stating that Mr. Taylor has no business affiliation and no information concerning Scott Green’s employment verification letter.

I have spoken to and emailed Scott Green’s prosecutor, James Arnold (attached 03/26/13 email). He told me to refer the new evidence to you for investigation and possible prosecution for forgery. Scott Green had his federal conviction jurisdiction moved to Arizona on his 2005 Medicare Fraud Felony when he moved to Arizona.

Scott Green has abused and defrauded seniors at SGRV for nearly eight years but the local police do nothing. Sadly I know of 58 senior abuse cases and 33 of those seniors have died with no justice. My wife is dying due to rejection of her transplanted liver because Scott Green retaliated and refused to clean the toxic mold from her SGRV apartment. What is really shocking that Scott Green and the attorney Scott E. Williams have a Court Sanctioned Senior Financial Exploitation Scam in process at the Arrowhead Justice Court. SGRV sues the seniors who are forced to move because of the lack of the advertised and promised medical services and file baseless lawsuits. The Court is manipulated by SGRV’s attorney Scott E. Williams and has lost all records and the 07/08/10 trial recording on my lawsuit against SGRV #CC2010-038658.

SGRV is a cash poor senior living center because it is one of the properties involved in the AREI/Oakdale Heights Ponzi scheme (2,000 investors lost $250 million) which is now on trial in California. The 20 owners of SGRV lost $4.5 million on their SGRV investment. The SGRV owners committed many illegal deeds with the help of the felon Scott Green which I have documented in my attached April 2013 SGRV criminal activity CD which I gave to the state lawmakers and press on 04/09/13. The local police and Arizona Attorney General ignore the illegal activities at SGRV to protect attorney Williams.

Please review the documentation and help bring Justice to Arizona.

Sun Grove Resort Village (SGRV) is running an internet scam which dupes seniors with its misleading and false advertising. SGRV advertises that it is a licensed assisted living facility with a licensed nurse, which is untrue. SGRV has an elder abuse operation of terror, threats, and baseless lawsuits in order to fund the undercapitalized senior living facility. I have been reporting this illegal activity since September, 2009, to HUD, Peoria Police, Better Business Bureau, the Arizona Department of Health Services, the Arizona Board of Nursing, the Justice Court System, the Agency on Aging, the Maricopa County Attorney, and the Arizona Attorneys General with no success. The reason I am blocked is the fact that SGRV’s attorney is Scott E Williams, a well-connected elections attorney who gets favorable treatment and breaks the law in order to win at any cost.

Mr. Williams is a very active evictions attorney, who has prosecuted over 100,000 evictions in the past 20 year. Mr. Williams is active in buying homes in short-sales which makes huge profits by renting back the home to the former owners. Mr. Williams has over ten foreign corporations of investment groups where he shares in his unethical business operation blood money achieved by preying on the poor, old, and sick. Laure Roberts reported on 11/20/11 how Mr. Williams took advantage the cancer-sick Hazel Nitis in a short-sale scam and reported he profited $100,000 in a few days. Mr. Williams has a court sanctioned ELDER FINANCIAL EXPLOITATION scam in progress that has extorted over $70,000 from 10 seniors with SGRV baseless lawsuit. We have been reporting this illegal activity to the Arizona Attorneys General but they do nothing because he is the county official’s election attorney. We have now gone to HUD, FBI, Senator McCain, and President Obama for Justice. Our fair housing HUD Complaint has been poorly handled for the past 950+ days and Senator McCain has referred the problem to the OFFICE OF THE INSPECTOR GENERAL OF HUD.

We have new evidence to report to the FBI, which is:

1. SGRV just duped a sick senior and forced her to sign a contract and pay SGRV’s rent. This was just reported on Channel 3 news and YELP INTERNET that SGRV locked the sick senior out of her apartment because she complained she was lied to by SGRV. SGRV falsely advertised nonexistent health services and abused this senior (Exhibit #1: 5/1/12 YELP Complaint & 5/5/12 email from victim’s friend).

2. We believe Scott Williams assaulted us on the internet with a highly derogatory posting to the Arizona Republic Newspaper on 3/13/12 (Exhibit #2: 3/13/12 AZ Republic email).

3. Claudia Marquez is the imposter nurse at SGRV and she was cited before on 3/25/05 for that illegal nurse misrepresentation. She continues to misrepresent that she is the SGRV Nursing Director in the 11/13/11 Dun and Bradstreet Report (Exhibit #3: Imposter nurse documentation).

 

4. Scott Green is the SGRV executive director but he often misrepresents himself as a doctor. He did this in our complaint to the Board of Nursing to the Grabach family. Mr. Green now misrepresents himself as doctor on the website www.doctors-look.com (Exhibit #4: 5/6/12 Doctors-look website).

5. SGRV continues to misrepresent that it is an assisted living facility in: One click Med, Elder Care Choice, FSN Hospitals.com, assisted senior living.net, Living Options (Exhibit #5: 5/6/12 five internet sites with false SGRV advertising). I received the 11 contracts for other internet sites where SGRV signed the agreements that it is an assisted living facility. This evidence was present to the AAG but nothing was done to stop the illegal internet activity

5. SGRV is undercapitalized and the 5/7/12 CORTERA Company Financial Profile shows that their rating is declining. The BBB has recently removed SGRV rating and state they are updating the SGRV rating (Exhibit #6: 5/7/12 CORTERA rating and BBB rating).

6. We continue to be harassed for SGRV’s baseless lawsuits since the Arizona State Tax department withheld our $50 refund to pay for appeal fees. This penalty is for a illegal trial from a court  that destroyed all evidence and documents to cover-up their fraudulent activities (Exhibit #7: 4/27/12 Letter from AZ Department of Revenue).

STANLEY FISHMAN V. SUN GROVE RESORT VILLAGE

THE STANLEY FISHMAN ABUSE STORY AT SUN GROVE RESORT VILLAGE (SGRV)

Stanley Fishman lived at SGRV from the end of 2009 to the end on 2011, two years, in the SGRV apartment #2027 which was directly above Carol Fairall's SGRV apartment #1027.  Mr. Fishman said there was always a terrible smell in his apartment. He was alarmed when I informed him that Carol's SGRV apartment tested positive for toxic mold. Mr. Fishman dropped off his SGRV Questionnaire for the CLASS ACTION LAWSUIT on 04/12/13.

Stanley Fishman's SGRV Questionnaire dated 04/07/13 documented:

1.  That Scott Green used false advertising. 

2.  Mr. Fishman reported that Scott Green lied about Claudia Marquez, the impostor nurse. Mr. Fishman said: "He claimed she was a registered nurse when she wasn't even a nurse."

3. Mr. Fishman that Scott Green used threats and was rude, he stated: "All ways threaten to put you out." "He was a dictator." He gave no respect to anyone."

4. Mr. Fishman said that Scott Green collected part cash and part check for the rent, he said: "He made you pay some moneys in cash and the rest in a check. He pocked the cash." 

5. Mr. Fishman stated about SGRV's lawyer, Scott E. Williams the following: "He's friendly helper Scott Green to win every case. No one had a chance to win. He had strength in court. He knew everyone."

6.  Mr Fishman reported problems with the 24/7 emergency alarm system. He stated: "Most of the time it was broken."

PAM KLEIN'S DOG WAS KILLED BY SCOTT GREEN

Mr. Fishman told the very sad story about Pam Klein who lived SGRV. Ms. Klein lived with Clay Haning, her caregiver, in SGRV apartment #1018. When Mr. Haning died his family had to fight to get the $18,000 prepaid rent back.  Channel 3 ON YOUR SIDE helped to recover the money for Mr. Haning's daughter Shari Parrott because the Peoria Police did nothing.

KILLED BY SGRV'S SCOTT GREEN

SGRV moved Ms. Klein, who had to use an electric scooter, to a single bedroom apartment on the second floor. Scott Green required Ms. Klein to keep her dog "Buddy", her cocker spaniel,  leashed all the time. It was very difficult for Ms. Klein to use the small SGRV elevator with her electric scooter while trying to control her leashed dog. SGRV only had four very small elevators in the eight SGRV buildings. 

"Buddy" jumped out of the SGRV elevator when Ms. Klein pushed the button to go to the second floor. The SGRV elevator doors do not have sensored emergency stopping doors or working emergency phones. Buddy was hung to death! 

Scott Green made no apologies or restitution for Ms. Klein's murdered dog. 

Mr. Fishman asked for me to be a witness for his $55,000 lawsuit against SGRV for the work he did there but was unpaid. I was fully aware how Scott Green refused to pay his contractors and vendors. I agreed to be a witness for Mr. Fishman in his lawsuit against SGRV. I wrote the following letter:

Dear Mr. Fishman:

It was good to visit with you yesterday at my home. I am truly sorry about your problems with SGRV, Scott Green, and

I, Mark Fairall, will be glad to testify in your behalf at your trial against SGRV. 

SGRV is the vexatious litigate because the company sues seniors who move early because the senior living facility does not have the advertised and promised medical services. Also, SGRV is involved with many lawsuits involving its contractors, suppliers, and seniors wanting their deposits returned. SGRV misuses the legal system with Baseless Lawsuits and Avoidance Lawsuits to raise operating capital and to pay less on its bills. I am very familiar with one lawsuit from SGRV’s alarm company Supreme Fire Protection, owner Brian Keown, who had to settle in a lawsuit for $2,500 of the $10,000 bill owed by SGRV.  I am familiar with Sam Kieffer who lived in my rental home with his father, SGRV employee George Kieffer, and how he was only able to collect $3,500 of the $5,000 bill SGRV owed him for painting the SGRV clubhouse.  I am very familiar that the SGRV food vendors had such a difficult time collecting their bills that they put SGRV on a “Cash Only” system of buying for the SGRV kitchen. I was the president of the SGRV Ambassador Committee, the residents’ complaint board, and I was barraged with complaints from residents, contractors, and suppliers. I was able to get my former employer, Bank of America, to stop the foreclosure on the SGRV property and write a workout mortgage in 2008.

The SGRV 20 Investor/Owners received in 2008 the Deeded ownership from the failed Ponzi scheme AREI/Oakdale Heights (2,000 Investors lost $250 million and it is now in trial in California). Previously the SGRV Investors had a tenants-in-common form of ownership in 2006. I am very familiar with SGRV past financial statements and poor financial business practices. The 20 SGRV Investor/Owners lost $4.5 million on the poor SGRV investment. They ran the property into the ground with poor management, poor property maintenance, and illegal dealings.  The SGRV property needs to be destroyed because it is a health hazard with dilapidated buildings, dangerous electrical wiring, and toxic mold.

12/20/12 LETTER TO CAROL FAIRALL FROM PRESIDENT AND MRS. OBAMA

My wife, Carol, is dying, like our three dogs died, from the SGRV toxic mold exposure which caused the start of the rejection of her transplanted liver in September 2009. We have $18,000 of wrongful judgments at the Arrowhead Court on SGRV Baseless lawsuits when we forced to move because SGRV failed to provide a safe and healthy place to live. SGRV and Scott E. Williams refuse our and our attorney’s letters and emails for a REASONABLE ACCOMMODATION REQUEST FOR A DISABLE PERSON to continue to accept Carol’s medication like it did before we filed complaints against SGRV on 09/13/09 with HUD and the Arizona Attorney General for fair housing violations. Attorney Felicia Rotellini represented us for free after she reviewed our documentation to try to get HUD to prosecute SGRV but HUD is broken and refused her requests.  I have extensive documentation and testimonies taken by our private investigator and I am in the final stages of preparing a Class Action Lawsuit representing the 58 abused and exploited SGRV seniors. Carol and I teach elder abuse prevention classes, write elder abuse prevention articles, and work to improve senior protection laws with the state and federal lawmakers. Because of Carol’s declining health, her liver rejection numbers are now critical at eleven time higher than normal, she has received letters of thanks for her efforts to protect others seniors from elder abuse and senior financial exploitation from President and Mrs. Obama and the Department of Health & Human Services.

MARK FAIRALL

I sued SGRV to collect the illegally collected service dog fees and to recover the cost of my SGRV apartment upgrades. I requested a change in venue in our 2010 Trial for our lawsuit #CC2010-038658 because Scott E. Williams was representing the returning judge Lex Anderson at the time of our trial but I was denied.  I requested a jury trial but I was denied.  I requested a change in SGRV’s attorney Scott E. Williams but I was denied. I requested to enjoin the SGRV owners but I was denied.  I requested the judge to allow my evidence since the Police told me to withhold it for the pretrial, which never happened, but I was denied. My 300+ pages of evidence were thrown out of court. I requested more time because my witnesses were tampered with by Scott Green and Scott E. Williams and they were too scared to come to trial but I was denied. I asked for a continuance of the trial because our main witness, Cliff Dyrland, was in coma in a hospital but I was denied.  I requested to cross examine all of SGRV’s witnesses but I was denied.  I filed Appeals but they were denied. The Arrowhead Justice Court has destroyed our evidence and the recording of the 07/08/10 Trial in its cover-up of Scott E. Williams’ illegal actions.

SGRV’s attorney Scott E. Williams is the most devious, insensitive, and corrupt attorney that I have ever dealt with.  I have experience with in over a dozen lawyers (Paul Eckstein, Michael Clyde, Robert Pohlman, and Stuart Goldstein to name a few) in my job as a bank vice president and personally. Scott E. Williams manufactured false evidence, tampered with witnesses, and lied to the Arrowhead Justice Court and HUD Federal Officials.  The documentation includes our FRAUD OF THE COURT MOTION which showed the 27 violations by Scott E. Williams of laws and Arizona Rules of Professional Conduct.

I filed complaint #10-0232 with the Arizona Bar against Scott E. Williams but it is ignored because he is protected by Maricopa county official. In 2004, the Maricopa County Board of Supervisors (MCBS) hired Scott E. Williams to represent Maricopa Officials, Politicians, and Judges on election matters. All our communications to the MCBS has been ignored.  All our communications the head of the Superior Court, Norman Davis, about Scott E. Williams and the former judge Melanie Deforest (she withdrew from the 2012 election in disgrace for lying about her education and past work experience) was ignored. The Judicial Conduct Commission declined my complaint about Judge Melanie Deforests favoritism to Scott E. Williams, failing to follow proper court procedures, failing to understand the law, and failing to maintain the high dignity of the court by being extremely rude to both my wife and me.

Based upon my experience your chance of collecting your fees of $55,000 for the work you did at SGRV has little chance for a fair trial in Maricopa County and you have no chance for collecting any judgment awarded to you. The trial will be blocked by SGRV’s attorney Scott E. Williams because he will bury you in legal trickery and extensive motions.

I find it shocking that Scott E. Williams represents the felon Scott Green. Scott E. William is a bigger crook that Scott Green by taking advantage of the elderly in senior living facilities with Baseless Lawsuits and aiding the felon Scott Green’s illegal collection and debt avoidance activities.  Scott E. Williams needs to be disbarred and be incarcerated.

We have filed formal complaints with the FBI, IC3, Department of Justice, Senator McCain, and President Obama about SGRV, Scott Green, Scott E. Williams, and Arizona Attorney General Tom Horne.

1. 04/01/13 – THE PONZI SCAM - California’s largest PONZI SCAM, AREI/OAKDALE HEIGHTS, went to trial on 02/06/13. The mastermind, James Koenig is charged with 42 counts of criminal fraud. James Koenig refused the plea-agreement and elected to go to trial.  This Ponzi scam defrauded 2,000 investors of $250 million. The James Koenig’s Trial is scheduled to last three months until April 2013. ASSET & REAL ESTATE INVESTMENT (AREI) bought the 24 senior living facilities and OAKDALE HEIGHTS was the management company that managed the properties. Sun Grove Resort Village (SGRV) is one of the 24 senior living properties that are involved in the AREI/OAKDALE HEIGHTS Ponzi trial.

2. 04/02/13 – GREED DESTROYED 24 SENIOR LIVING FACILITIES (INCLUDING SGRV) -The current AREI/OAKDALE HEIGHTS Ponzi trial’s mastermind, James S. Koenig, bought 26 properties (24 senior living facilities, a golf course, and an office building) with cash and then he leveraged them with 100% financing to support his lavish lifestyle. Koenig doubled dipped by passing the zero-equity-valued properties off to investors at an inflated value with the promise of huge tax-free investment returns. It was that GREED that destroyed all of the AREI/OAKDALE HEIGHTS properties, caused the loss of the Investors money, and killed the lifestyle of the seniors that lived in the 24 senior living facilities.  

3.  04/03/13 – SOME SGRV ELDER ABUSE AND SENIOR FINANCIAL EXPLOITATION STORIES - A few of the SGRV elder abuse and fraud stories were told, they were: Laura Lee Boyd, Cliff Dyrland, George Grabach, Daniel Monroe, Earl McHenry, Millie Toedebusch, Catherine Reinertson, Wheeler the sheltie service dog, Bridget and Brittany the Yorkie sister dogs, and Carol Fairall.

4.  04/04/13 – SGRV’s TOXIC MOLD AND POOR LIVING CONDITIONS - SGRV attempted cover up of the toxic mold problems, and the dangerous living conditions at SGRV. SGRV’S attorney Scott E. Williams aided the felon Scott Green, former manager of SGRV, in covering up the toxic mold problem with phony documentation and hired the mold inspector when the fly-by-night mold company went out of business. It is shocking that an attorney would do such illegal things to help the 2005 Medicare Fraud Felon Scott Green. Scott E. Williams was hired by the Maricopa County Board of Supervisors in 2004 to represent the county's official and politicians so he is "PROTECTED."

5.  04/05/13 - SGRV’S GUILTY PARTIES – GREEN, NUNLEY, AND SENIORITY INC. - SGRV's Guilty Parties of Elder Abuse and Fraud are: Scott Green, Karl Nunley, and Seniority Inc. (the former Management Company of SGRV). This articled detailed the involved of all the guilty parties.

6.  04/06/13 – SGRV’S CROOKED LAWYER, WILLIAMS, AND INCOMPETENT JUDGE, DEFOREST - The first public document is our 07/25/11 FRAUD OF THE COURT Motion which showed all Scott E. Williams' trickery, illegal actions, and the favoritism that he received.  The second public document is our 09/09/10 JUDICIAL COMPLAINT against the Arrowhead Justice Court's pro-per judge Melanie Deforest which documents all her mistakes. The Arrowhead Justice Court destroyed all our evidence and 07/08/10 Trial Recording in its cover-up of the Court Sanctioned Financial Exploitation Scam.

7.  04/07/13 – HUD IS BROKEN - HUD productivity has declined in the past 20 years. The current HUD Secretary Shaun Donovan has completely BROKEN HUD. Donovan got his job as a favor from President Obama for helping him get elected to President in 2008. HUD has had a huge decrease of Fair Housing Lawsuits (1 out of 1,000), enormous wasteful Community Development Programs ($1 billion has been lost in the HUD Katrina Project), and now HUD is the Nation's Biggest SLUMLORD of Substandard and Dangerous Housing.

HUD has a Conflict of Interest in the investigation of our three and a half year Fair Housing Complaint against Sun Grove Resort Village (SGRV) since HUD approved SGRV as a Low Income Housing a few years ago. How can HUD approved the substandard and dangerous mold filled SGRV property and subsidize the poor peoples' SGRV rent? It is no wonder our HUD Fair Housing Complaint was ignored because HUD supports SGRV. That is a huge CONFLICT OF INTEREST! SGRV became a HUD Low Income Housing property at the same time HUD was reviewing our Fair Housing Complaint. HUD supported SGRV by approving it to be HUD Housing and poorly investigating our SGRV Fair Housing Violations complaint.

8.  04/08/13 – THE STORY OF ELDER ABUSE AND SENIOR FINANCIAL EXPLOITATION AT SGRV - This article tells how Carol and I met at SGRV and the problems we had there. It summarizes our eight-days of SGRV story articles. I also show some of the pictures of SGRV in 2009 (for our Trial) and current moldy fountain pictures taken at SGRV on 04/07/13. The SGRV abused and defrauded list of 58 seniors is attached and 33 have died. Finally, I attached my poems “VULNERABLE ABUSE – A CRIME NO ONE HEARS” and “TEARS FROM HEAVEN.”

These are pictures at Arizona's Wall of Life Day on 04/09/13 at the state Capitol. Sadly they did not have Carol Fairall's picture displayed. They did have many other organ donors and recipients pictures displayed. It was an inspiring day talking to the few organ donors and recipients. They all had interesting stories to tell but many of them expressed disappointment that there was no ceremony, no press, and no real interaction by the lawmakers.

I observed the lawmakers and the homeless taking big portions (they ran out) of food. What a great country where the lobbyists feed them together. I observed very few lawmakers looking at the signs and stories of the organ donors and recipients. They just ate and ran. I observed tour groups of kids, many lobbyists, and very few visitors to Arizona's Political Heart. That says a lot...not much to see there

I observed a change of attitude in the state Capitol that I never witnessed years ago. Since I have lived here over 60-years I can speak from experience. Also my son use to work in the state Capitol. He told me Arizona does not care anymore and has lost its heart. He moved to North Dakota. Sadly, I agree with my son and the warmth is gone. I saw very few Lawmakers view the Wall of Life and the Organ Donors and Recipients had very little interaction with them. 

The one good thing I experienced was spending an hour with Representative Chad Campbell. We sat a table where he allowed me to share my elder abuse presentation and Sun Grove Resort Village story. He spent nearly an hour with me and ignored all the bells that tell the lawmakers to stop talking to you. He wants input from regular people and does not favor the rich or powerful. Lastly, he displayed the warmth that I saw at the Arizona state Capitol years ago. If Mr. Campbell runs for Arizona Governor he has our blessings and support.

Sadly, only one law of the our 15 proposed senior laws was passed this session which was the service dog law that gives more rights and less expenses for people who have service dogs. Thank you Representative David Livingston.

My service dog, Wheeler, passed away due to liver cancer from his exposure to toxic mold at Sun Grove Resort Village. The other organ donors and recipients expressed interest and concern about Carol being very sick from her transplanted liver rejection caused by the toxic mold at Sun Grove Resort Village. They were wonderful people. However, the rest of the public will not know our story and the other stories of the organ transplant donors and recipients because the Press was not there. It is no wonder the warmth is gone at the state Capitol because the public is uninformed.

Note: I did quickly speak to David Livingston and Phil Lovas in the hallways. I spoke to Rick Gray in his office
while he sat behind big desk in his very posh office. I had made appointments with Livingston, Lovas, Gray, 
and Campbell because I know it is difficult to see them.

TABLE TALK AT THE WALL OF LIFE DAY

There were ten other organ donor/recipient family members that sat at our table during the Wall of Life Day at the state Capitol on 04/09/13. Many of them shared their personal stories of organ donations. It was sad that the Press was not there at this important event to cover this worthwhile news rather than the salacious news of Jodi Arias murder trial.

One woman proudly announced that she was a three-generation organ donor family. She said her grandmother started the organ donating when she was killed in an auto accident and her heart was transplanted into a young boy. Helen was proud that she had donated her kidney to her sister. Finally, she shared that her daughter had recently died and that many of her organs were transplanted to several people. This is a Family that deserves respect and attention for being great Arizonan’s that care. We all cried at the loss of her daughter and blessed her and her family for giving others the Gifts of Life.

Another woman shared that her son was killed by accident several years ago and his organs, bones, and skin went to ten different people. She said that every Thanksgiving that she and those ten organ recipients celebrate and eat together. She said since she cannot have her son eat with her then that all ten of the organ recipients eat together in honor of her son. She calls herself the Thanksgiving Organ Donor Mom and they celebrate her son’s Gifts of Life and share Thanksgiving together. Those ten organ recipients are her only family now since her husband died. We all cried tears of sadness and joy at her story.

Finally, we had a lobbyist share his story that he is trying to get the Medicare Law passed by the current Lawmakers but he has such opposition. He said he worked in former Governor Jane Hull’s administration in the late 90’s and that she was a wonderful caring person. I said I could relate because Mrs. Hull was my client at the bank and she was one of my favorite customers. Mrs. Hull knew every one of my staff’s names and asked if they were OK when they were missing. I told the group that my family knew Senator Barry Goldwater who helped get my mom’s citizenship papers.  My favorite story was how Senator Carl Hayden spent time with me in his ASU Library Office, when I was a freshman, telling me stories about his past. I personally knew Governor Rose Mofford, when I was chairman of the Sunnyslope Redevelopment Corporation, and that I had served on several of her boards. We all agreed that was a kinder and gentler time in Arizona’s political history. The 1999 Domestic Violence marker that was erected during Jane Hull’s Governorship shows how caring Arizona Government was at that time.

I was given the OK to share these stories (with no names) because no one would ever know them since the Press was not there and the Lawmakers were not listening. Both women are deeply religious and know their deceased family members are with God. They both were very proud of their involvement with the organ donor program and wanted to urge others to be organ donors. They all expressed disappointed that the Press was not there nor did the Lawmakers interact with them. 

REPRESENTATIVE
CHAD CAMPBELL-D

We discussed Arizona Politics which was interesting and funny because most of us have lived in Arizona a long time. We all agreed the best Lawmakers are Representative Chad Campbell-D and Senator Leah Taylor-D. They all like how Mr. Campbell: fights gang violence, is trying to improve education and schools, is in favor of gun laws, and is not in the pocket of big business. They all like how Ms. Taylor fights: for the poor, the disadvantaged, and the children.  They were all impressed with Ms. Taylor’s concern for adoption, abused children, and Grandparents rights. 

SENATOR
JUDY BURGESS-R

We all agreed that the worst  Lawmakers were Representative Debbie Lesko-R and Senator Judy Burgess-R. They were all are disappointed that Debbie Lesko: reduced women’s rights to birth control, tried to take away the powers of the Corporation  Commission and Cities, that she was co-sponsor of controversial SB1070 with Russell Pearce-R, and that she was in the pocket of big business (ALEC). Judy Burgess won the award of being the most inept and outlandish Lawmaker with her:  witch-hunt Obama Birther Bill, support of guns on campus, her global conspiracies, her dismissal of global warming, and the fact she refuses personal meetings and public appearances. 

We discussed the 22 Governor that Arizona has had in the past 100 years. I have lived through 15 of those Governor terms and knew several personally (Jack Williams-R, Bruce Babbitt-D, Rose Mofford-D, and Jane Hull-D). We all agreed the best Governor was Bruce Babbitt-D, 03/04/78 to 01/05/87, because he boosted Arizona’s reputation to tourists by expanding the parks system and that Arizona prospered during his leadership. Bruce Babbitt went on to be President Clinton’s-D Secretary of the Interior (01/22/93-01/02/01) where he protected the scenic and historic federal public lands.

The most embarrassing Governors were Evan Mecham-R who was impeached for misuse of campaign funds and Fife Symington-R who resigned because he defrauded banks.

JAN BREWER-R

Finally, we all agreed that Jan Brewer-R is the worst Governor because she balanced the budget by robbing the parks, schools, poor, disabled/sick, and children.

One woman said that she was glad that Governor Jan Brewer did not speak at the Wall of Life Day because she was the “GOVERNOR OF DEATH.”
